Nen\u00ed divu, nebo\u0165 tato z\u00e1sada je \u00fastavn\u011b zakotvena v \u010dl. 20 odst. 2 bonnsk\u00e9ho z\u00e1kladn\u00edho z\u00e1kona z roku 1949, kter\u00fd zn\u00ed:<\/p>\n<p><em>&#8222;Ve\u0161ker\u00e1 st\u00e1tn\u00ed moc poch\u00e1z\u00ed z lidu<\/em>. &#8220;<\/p>\n<p>Konkr\u00e9tn\u011b se jedn\u00e1 o princip lidov\u00e9 suverenity, kter\u00fd se li\u0161\u00ed od n\u00e1rodn\u00ed suverenity, kde moc vych\u00e1z\u00ed z n\u00e1roda, a\u010dkoli oba maj\u00ed stejn\u00fd z\u00e1klad, a to koncept modern\u00ed suverenity, kter\u00fd vymyslel francouzsk\u00fd filozof Jean Bodin a definoval jej jako &#8222;absolutn\u00ed a v\u011b\u010dnou moc republiky&#8220;.<\/p>\n<p>Podle spolkov\u00e9 republiky, kter\u00e1 vznikla v N\u011bmecku po druh\u00e9 sv\u011btov\u00e9 v\u00e1lce, je n\u011bmeck\u00fd lid p\u016fvodn\u00edm dr\u017eitelem politick\u00e9 moci, kterou z\u00e1sadn\u011b p\u0159en\u00e1\u0161\u00ed na st\u00e1t &#8211; co\u017e je mimochodem doktr\u00edna, kter\u00e1 je v rozporu s k\u0159es\u0165anstv\u00edm, ale to bychom odbo\u010dili od na\u0161\u00ed anal\u00fdzy.<\/p>\n<p>P\u0159evod moci z lidu na n\u011bmeck\u00fd st\u00e1t nen\u00ed definitivn\u00ed, proto\u017ee vys\u00edla\u010d a p\u0159\u00edjemce nad\u00e1le vykon\u00e1vaj\u00ed politickou moc, i kdy\u017e r\u016fzn\u00fdmi zp\u016fsoby; ostatn\u011b stejn\u00fd \u010dl\u00e1nek 20 odst. 2 bonnsk\u00e9ho z\u00e1kladn\u00edho z\u00e1kona pak vysv\u011btluje:<\/p>\n<p><em>&#8222;Tuto moc vykon\u00e1v\u00e1 lid prost\u0159ednictv\u00edm voleb a hlasov\u00e1n\u00ed a prost\u0159ednictv\u00edm konkr\u00e9tn\u00edch org\u00e1n\u016f moci z\u00e1konod\u00e1rn\u00e9, v\u00fdkonn\u00e9 a soudn\u00ed.<\/em>&#8220;<\/p>\n<p>A\u010dkoli tedy st\u00e1t disponuje takovou moc\u00ed, kter\u00e1 poch\u00e1z\u00ed od n\u011bmeck\u00e9ho lidu, politickou moc st\u00e1le vykon\u00e1v\u00e1 n\u011bmeck\u00fd lid p\u0159\u00edmo prost\u0159ednictv\u00edm sv\u00e9 \u00fa\u010dasti ve volb\u00e1ch a nep\u0159\u00edmo prost\u0159ednictv\u00edm akt\u016f zm\u00edn\u011bn\u00fdch st\u00e1tn\u00edch org\u00e1n\u016f.<\/p>\n<p>V souladu se z\u00e1sadou lidov\u00e9 suverenity, jak je stanovena v bonnsk\u00e9m z\u00e1kladn\u00edm z\u00e1kon\u011b, \u00fastavn\u00ed soudci ve v\u011bci <em>Weiss <\/em>rozv\u00edjej\u00ed n\u00e1sleduj\u00edc\u00ed argumentaci:<\/p>\n<p>&#8222;<em>[Corresponding to the principle of popular sovereignty] <\/em> je pr\u00e1vo ob\u010dan\u016f podl\u00e9hat pouze t\u011bm org\u00e1n\u016fm ve\u0159ejn\u00e9 moci, kter\u00e9 mohou legitimizovat a ovlivnit. &#8220;<\/p>\n<p>P\u0159\u00edslovce &#8222;pouze&#8220; je podle na\u0161eho n\u00e1zoru pom\u011brn\u011b z\u00e1sadn\u00ed, nebo\u0165 nazna\u010duje, \u017ee n\u011bme\u010dt\u00ed ob\u010dan\u00e9 nepodl\u00e9haj\u00ed \u017e\u00e1dn\u00e9 ve\u0159ejn\u00e9 moci, kterou by nemohli legitimizovat a ovlivnit.<\/p>\n<p>Je to zcela logick\u00e9, nebo\u0165 jako dr\u017eitel\u00e9 politick\u00e9 moci podl\u00e9haj\u00ed ve\u0159ejn\u00fdm org\u00e1n\u016fm, pokud zas\u00e1hli do jejich volby, kter\u00e1 je tak legitimizov\u00e1na n\u011bmeck\u00fdm lidem a kterou m\u016f\u017ee n\u011bmeck\u00fd lid nad\u00e1le ovliv\u0148ovat.<\/p>\n<p>A pokud by tyto d\u016fsledky principu suverenity ve prosp\u011bch n\u011bmeck\u00e9ho n\u00e1roda nebyly dostate\u010dn\u011b siln\u00e9, soudci z Karlsruhe dod\u00e1vaj\u00ed:<\/p>\n<p>&#8222;<em>[The principle of popular sovereignty] <\/em> vy\u017eaduje, aby ka\u017ed\u00fd akt org\u00e1n\u016f ve\u0159ejn\u00e9 moci vykon\u00e1van\u00fd v N\u011bmecku bylo mo\u017en\u00e9 zp\u011btn\u011b vysledovat k jeho ob\u010dan\u016fm. &#8220; <\/p>\n<p>Proto by v N\u011bmecku nem\u011bl existovat \u017e\u00e1dn\u00fd v\u00fdkon ve\u0159ejn\u00e9 moci, kter\u00fd by nemohl vych\u00e1zet z rozhodnut\u00ed n\u011bmeck\u00fdch ob\u010dan\u016f. M\u016f\u017eeme dodat, \u017ee v N\u011bmecku by nem\u011bl existovat \u017e\u00e1dn\u00fd v\u00fdkon ve\u0159ejn\u00e9 moci, za kter\u00fd by n\u011bmeck\u00fd lid nemohl n\u00e9st odpov\u011bdnost.<\/p>\n<p>Spolkov\u00fd \u00fastavn\u00ed soud v\u0161ak je\u0161t\u011b v\u00fdslovn\u011b uv\u00e1d\u00ed t\u0159et\u00ed d\u016fsledek, kter\u00fd se t\u00fdk\u00e1 politick\u00e9 reprezentace, jak vypl\u00fdv\u00e1 ze z\u00e1sady lidov\u00e9 svrchovanosti:<\/p>\n<p><em>&#8222;To zakazuje pod\u0159\u00eddit ob\u010dany politick\u00e9 moci, p\u0159ed kterou nemohou uniknout a na kterou v z\u00e1sad\u011b nemohou m\u00edt svobodn\u00fd a rovn\u00fd vliv, a to jak pokud jde o jejich z\u00e1stupce, tak o jejich v\u011bcn\u00e1 rozhodnut\u00ed.<\/em>&#8220;<\/p>\n<p>N\u011bme\u010dt\u00ed soudci vysv\u011btluj\u00ed, \u017ee t\u0159i v\u00fd\u0161e uveden\u00e1 tvrzen\u00ed plat\u00ed i nad\u00e1le, pokud jde o Evropskou unii a za\u010dlen\u011bn\u00ed N\u011bmecka do t\u00e9to mezin\u00e1rodn\u00ed organizace.<\/p>\n<p>To je skute\u010dn\u011b dal\u0161\u00ed d\u016fle\u017eit\u00e9 up\u0159esn\u011bn\u00ed, kter\u00e9 d\u00e1le up\u0159es\u0148uje limity \u010dinnosti EU:<\/p>\n<p><em>&#8222;Z\u00e1kladn\u00ed z\u00e1kon neoprav\u0148uje org\u00e1ny n\u011bmeck\u00e9ho st\u00e1tu p\u0159en\u00e1\u0161et svrchovan\u00e9 pravomoci na Evropskou unii takov\u00fdm zp\u016fsobem, \u017ee by Evropsk\u00e1 unie byla opr\u00e1vn\u011bna p\u0159i samostatn\u00e9m v\u00fdkonu sv\u00fdch pravomoc\u00ed vytv\u00e1\u0159et nov\u00e9 kompetence ve sv\u016fj prosp\u011bch.<\/em>&#8220;<\/p>\n<p>Toto tvrzen\u00ed je dvoj\u00ed. Na jedn\u00e9 stran\u011b pop\u00edr\u00e1 mo\u017enost, aby si Evropsk\u00e1 unie vytv\u00e1\u0159ela jin\u00e9 pravomoci ne\u017e ty, kter\u00e9 j\u00ed sv\u011b\u0159ily suver\u00e9nn\u00ed \u010dlensk\u00e9 st\u00e1ty.<\/p>\n<p>P\u0159ipome\u0148me, \u017ee z\u00e1sadu p\u0159ednosti pr\u00e1va EU vytvo\u0159il Soudn\u00ed dv\u016fr Evropsk\u00e9 unie sv\u00fdm rozsudkem <em>Costa\/ENEL<\/em> z roku 1964. To sice striktn\u011b neznamen\u00e1 vytvo\u0159en\u00ed pravomoc\u00ed, ale nen\u00ed pochyb o tom, \u017ee nep\u0159\u00edmo skute\u010dnost, \u017ee org\u00e1n EU (a nikoliv \u010dlensk\u00e9 st\u00e1ty) ud\u011bluje nad\u0159azenost pr\u00e1vu Unie, \u010d\u00edm\u017e p\u0159isuzuje v\u011bt\u0161\u00ed pravomoci jak spoluz\u00e1konod\u00e1rn\u00fdm org\u00e1n\u016fm Unie (Parlamentu a Rad\u011b), tak tomu, kdo je pov\u011b\u0159en navrhov\u00e1n\u00edm a uplat\u0148ov\u00e1n\u00edm pr\u00e1va Unie (Komisi), a tak\u00e9 nejvy\u0161\u0161\u00edmu org\u00e1nu odpov\u011bdn\u00e9mu za v\u00fdklad pr\u00e1va (Soudn\u00edmu dvoru Evropsk\u00e9 unie), znamen\u00e1 vytvo\u0159en\u00ed v\u011bt\u0161\u00ed pravomoci z jejich vlastn\u00edho rozhodnut\u00ed, tedy nez\u00e1visle. Pr\u00e1v\u011b to nakonec \u00dastavn\u00ed soud v Karlsruhe p\u0159ipom\u00edn\u00e1, \u017ee Evropsk\u00e1 unie v souladu s principem lidov\u00e9 suverenity, kter\u00fd hl\u00e1s\u00e1 n\u011bmeck\u00fd z\u00e1kladn\u00ed z\u00e1kon, nem\u016f\u017ee. Rozsudek ve v\u011bci <em>Weiss<\/em>, kter\u00fd se t\u00fdk\u00e1 svrchovanosti lidu, tak v sob\u011b obsahuje rozs\u00e1hl\u00fd prvek proti jak\u00fdmkoli n\u00e1rok\u016fm na p\u0159ednost pr\u00e1va EU.<\/p>\n<p>M\u016f\u017ee se v\u0161ak zd\u00e1t zar\u00e1\u017eej\u00edc\u00ed, \u017ee tent\u00fd\u017e rozsudek p\u0159ipou\u0161t\u00ed existenci ur\u010dit\u00e9ho p\u0159enosu svrchovan\u00fdch pravomoc\u00ed na Evropskou unii, ov\u0161em pod podm\u00ednkou, \u017ee tento p\u0159enos bude proveden v rozsahu a form\u011b p\u0159ijat\u00e9 <em>Spolkov\u00fdm<\/em> sn\u011bmem.<\/p>\n<p>Hlavn\u00ed org\u00e1n, kter\u00fd vytv\u00e1\u0159\u00ed vnitrost\u00e1tn\u00ed pr\u00e1vn\u00ed normy, jako\u017e i tyto pr\u00e1vn\u00ed produkty, v\u010detn\u011b t\u011bch, kter\u00e9 obsahuj\u00ed p\u0159enos svrchovan\u00fdch pravomoc\u00ed nebo fakult, maj\u00ed proto st\u00e1le vy\u0161\u0161\u00ed postaven\u00ed ne\u017e legislativn\u00ed v\u00fdkon jm\u00e9nem org\u00e1n\u016f EU podle takov\u00e9ho p\u0159enosu.<\/p>\n<p>Z obou t\u011bchto d\u016fvod\u016f &#8211; nemo\u017enosti Evropsk\u00e9 unie samostatn\u011b vykon\u00e1vat sv\u00e9 pravomoci k vytv\u00e1\u0159en\u00ed nov\u00fdch pravomoc\u00ed ve sv\u016fj prosp\u011bch (v\u010detn\u011b nep\u0159\u00edm\u00e9ho judikatorn\u00edho vytvo\u0159en\u00ed z\u00e1sady p\u0159ednosti) a podm\u00edn\u011bnosti p\u0159enosu svrchovan\u00fdch pravomoc\u00ed p\u0159ijet\u00edm hlavn\u00edm z\u00e1konod\u00e1rn\u00fdm org\u00e1nem st\u00e1tu &#8211; m\u00e1 z\u00e1sada lidov\u00e9 svrchovanosti v N\u011bmecku jednozna\u010dn\u011b p\u0159ednost p\u0159ed jak\u00fdmkoli n\u00e1rokem na p\u0159ednost ve prosp\u011bch pr\u00e1va Evropsk\u00e9 unie.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>6.- Nad\u0159azenost n\u00e1le\u017e\u00ed z\u00e1kladn\u00edmu z\u00e1konu a n\u011bmeck\u00fdm n\u00e1rodn\u00edm org\u00e1n\u016fm:<\/strong><\/p>\n<p>Podle Spolkov\u00e9ho \u00fastavn\u00edho soudu existuj\u00ed \u010dty\u0159i n\u011bmeck\u00e9 org\u00e1ny, kter\u00e9 kontroluj\u00ed akty Evropsk\u00e9 unie &#8211; spolkov\u00e1 vl\u00e1da, ji\u017e zm\u00edn\u011bn\u00fd <em>Spolkov\u00fd sn\u011bm<\/em>, <em>Spolkov\u00e1 rada (Bundesrat)<\/em> a samoz\u0159ejm\u011b samotn\u00fd Spolkov\u00fd \u00fastavn\u00ed soud.<\/p>\n<p>Prvn\u00ed t\u0159i jsou zodpov\u011bdn\u00e9 za t\u0159i mo\u017en\u00e9 zp\u016fsoby kontroly, a to:<\/p>\n<p>&#8222;<em>dohl\u00ed\u017eet na to, zda org\u00e1ny, instituce, subjekty, \u00fa\u0159ady a agentury Evropsk\u00e9 unie dodr\u017euj\u00ed tyto p\u0159edpisy.  [Germany&#8217;s]  evropsk\u00e9ho integra\u010dn\u00edho programu, ne\u00fa\u010dastnit se p\u0159ij\u00edm\u00e1n\u00ed a prov\u00e1d\u011bn\u00ed opat\u0159en\u00ed, kter\u00e1 p\u0159ekra\u010duj\u00ed meze tohoto programu, a v p\u0159\u00edpad\u011b, \u017ee takov\u00e1 opat\u0159en\u00ed p\u0159edstavuj\u00ed zjevn\u00e9 a struktur\u00e1ln\u011b v\u00fdznamn\u00e9 p\u0159ekro\u010den\u00ed pravomoc\u00ed Evropsk\u00e9 unie, aktivn\u011b p\u0159ij\u00edmat rozhodnut\u00ed, kter\u00e1 zajist\u00ed soulad uveden\u00e9ho integra\u010dn\u00edho programu a dodr\u017eov\u00e1n\u00ed jeho mez\u00ed.<\/em>&#8222;.<\/p>\n<p>Co se t\u00fd\u010de n\u011bmeck\u00e9ho Spolkov\u00e9ho \u00fastavn\u00edho soudu, ten m\u00e1 rovn\u011b\u017e nad\u0159azenost nad subjekty Evropsk\u00e9 unie v tom smyslu, \u017ee<em>&#8222;prov\u00e1d\u00ed p\u0159ezkum ultra vires, aby posoudil, zda jsou spln\u011bny v\u00fd\u0161e uveden\u00e9 po\u017eadavky<\/em>&#8222;. Jin\u00fdmi slovy, <em>Weiss<\/em> p\u0159ipom\u00edn\u00e1 nad\u0159azenost \u010dty\u0159 n\u00e1rodn\u00edch instituc\u00ed nad ka\u017edou evropskou instanc\u00ed. \u010cten\u00e1\u0159 si m\u016f\u017ee tuto nad\u0159azenost snadno spojit s v\u00fd\u0161e uveden\u00fdm principem lidov\u00e9 suverenity.<\/p>\n<p>Soud v Karlsruhe v\u0161ak v\u00fdslovn\u011b p\u0159id\u00e1v\u00e1 vlastnost politick\u00e9 stavby vytvo\u0159en\u00e9 po druh\u00e9 sv\u011btov\u00e9 v\u00e1lce:<em>&#8222;Nad\u0159azenost \u00fastavy<\/em>&#8222;.<\/p>\n<p>To znamen\u00e1, \u017ee bonnsk\u00fd z\u00e1kladn\u00ed z\u00e1kon obsahuje ustanoven\u00ed (a lze tedy vyvodit analogii pro v\u0161echny ostatn\u00ed \u010dlensk\u00e9 st\u00e1ty), kter\u00e1 maj\u00ed p\u0159ednost p\u0159ed celou sb\u00edrkou p\u0159edpis\u016f EU, jak byly p\u0159ijaty v Bruselu a \u0160trasburku a vykl\u00e1d\u00e1ny v Lucemburku.<\/p>\n<p>Pokud jde o postaven\u00ed N\u011bmecka v r\u00e1mci Evropsk\u00e9 unie (a trv\u00e1me na tom, \u017ee je t\u0159eba prov\u00e9st nezbytnou analogii se v\u0161emi ostatn\u00edmi pr\u00e1vn\u011b rovnopr\u00e1vn\u00fdmi \u010dlensk\u00fdmi st\u00e1ty), zahrnuje tato n\u00e1rodn\u00ed nad\u0159azenost<em>&#8222;prov\u00e1d\u011bn\u00ed a dal\u0161\u00ed utv\u00e1\u0159en\u00ed a rozvoj integra\u010dn\u00edho programu tak, aby byly respektov\u00e1ny jeho hranice<\/em>&#8222;.<\/p>\n<p>Bonnsk\u00fd z\u00e1kladn\u00ed z\u00e1kon tak funguje jako hranice, nad kterou nelze p\u0159ij\u00edmat pr\u00e1vo Unie.<\/p>\n<p>Z logiky v\u011bci vypl\u00fdv\u00e1, \u017ee obsah evropsk\u00e9ho pr\u00e1va nem\u016f\u017ee b\u00fdt v rozporu s vnitrost\u00e1tn\u00edm v\u00fdvojem \u00fastavn\u00edch p\u0159edpis\u016f, kter\u00e9 maj\u00ed p\u0159ednost, nebo je p\u0159esahovat.<\/p>\n<p>Trv\u00e1me na tom, \u017ee tyto limity jsou kontrolov\u00e1ny zm\u00edn\u011bn\u00fdmi vysok\u00fdmi n\u00e1rodn\u00edmi institucemi; a \u017ee tyto limity jsou ur\u010deny vnitrost\u00e1tn\u00edm pr\u00e1vem, jak jsme prok\u00e1zali v \u010dl\u00e1nku.  <a href=\"https:\/\/www.theconservative.online\/primacy-of-german-law-over-european-union-law-i\">prvn\u00ed \u010d\u00e1st tohoto \u010dl\u00e1nku<\/a>, kter\u00e9 maj\u00ed proto p\u0159ednost p\u0159ed akty org\u00e1n\u016f EU a p\u0159\u00edpadn\u00fdmi d\u016fsledky N\u011bmecka jako \u010dlensk\u00e9ho st\u00e1tu Unie (nebo op\u011bt jak\u00e9hokoli jin\u00e9ho \u010dlensk\u00e9ho st\u00e1tu).<\/p>\n<p>&nbsp;<\/p>\n<p><strong>7.- Vy\u0161\u0161\u00ed demokratick\u00e1 legitimita potvrzuje n\u00e1rodn\u00ed prim\u00e1t:<\/strong><\/p>\n<p>Ani\u017e by to byl podle n\u011bmeck\u00e9ho \u00dastavn\u00edho soudu naprosto nezbytn\u00fd prvek, <em>Weiss<\/em> p\u0159esto zav\u00e1d\u00ed srovn\u00e1n\u00ed mezi demokratickou legitimitou instanc\u00ed Spolkov\u00e9 republiky a Evropsk\u00e9 unie &#8211; z \u010deho\u017e vypl\u00fdv\u00e1 nad\u0159azenost prvn\u00ed z nich i z tohoto hlediska.<\/p>\n<p>Pod\u00edvejme se na p\u0159esn\u00e9 podm\u00ednky soudc\u016f z Karlsruhe:<\/p>\n<p><em>&#8222;To plat\u00ed v je\u0161t\u011b v\u011bt\u0161\u00ed m\u00ed\u0159e, pokud ve\u0159ejnou moc vykon\u00e1vaj\u00ed subjekty, kter\u00e9 maj\u00ed jen slab\u00fd vztah k demokratick\u00e9 legitimit\u011b<\/em>.&#8220;<\/p>\n<p>Spolkov\u00fd \u00fastavn\u00ed soud nepop\u00edr\u00e1 ur\u010ditou demokratickou legitimitu org\u00e1n\u016f EU. Tato legitimita je v\u0161ak &#8222;slab\u00e1&#8220;, co\u017e se d\u00e1le rovn\u00e1 n\u00e1rodn\u00ed p\u0159evaze <em>ut supra<\/em>. Rozsudek ve v\u011bci <em>Weiss<\/em> v podstat\u011b spojuje demokratickou legitimitu jm\u00e9nem n\u011bmeck\u00e9ho lidu s n\u011bmeckou \u00fastavn\u00ed identitou, kter\u00e1 vylu\u010duje p\u0159ednost pr\u00e1va EU jako p\u0159edpoklad evropsk\u00e9 integrace.<\/p>\n<p>I kdyby byla demokratick\u00e1 kvalita evropsk\u00fdch instituc\u00ed pevn\u011bji zakotvena, st\u00e1le by platily prvky lidov\u00e9 suverenity, kontroly ze strany n\u00e1rodn\u00edch instituc\u00ed a nad\u0159azenosti bonnsk\u00e9ho z\u00e1kladn\u00edho z\u00e1kona. Nedostatek zdrav\u00e9 demokratick\u00e9 legitimity, kter\u00fd soud v Karlsruhe vyt\u00fdk\u00e1 instituc\u00edm, org\u00e1n\u016fm, \u00fa\u0159ad\u016fm a agentur\u00e1m Evropsk\u00e9 unie, v\u0161ak jen potvrzuje druho\u0159ad\u00e9 postaven\u00ed jejich \u010dinnosti ve vztahu k n\u00e1rodn\u00ed \u00farovni, kter\u00e1 je v ka\u017ed\u00e9m p\u0159\u00edpad\u011b na prvn\u00edm m\u00edst\u011b.<\/p>\n<p>Z praktick\u00e9ho hlediska je jist\u011b \u017e\u00e1douc\u00ed, aby Evropsk\u00e1 komise byla volena rovnost\u00e1\u0159\u0161t\u011bj\u0161\u00edm a transparentn\u011bj\u0161\u00edm zp\u016fsobem a m\u011bla m\u00e9n\u011b byrokratick\u00fd a tajn\u016fstk\u00e1\u0159sk\u00fd <em>modus operandi<\/em>. Takov\u00e9 p\u0159\u00edpadn\u00e9 zlep\u0161en\u00ed by v\u0161ak nem\u011blo rozhoduj\u00edc\u00ed dopad na n\u00e1rok EU na pr\u00e1vn\u00ed nad\u0159azenost nad \u010dlensk\u00fdmi st\u00e1ty.<\/p>\n<p>Ur\u010dit\u00fd respekt vyvol\u00e1v\u00e1, kdy\u017e se do\u010dteme, \u017ee je\u0161t\u011b v roce 2020 mus\u00ed soud v Karlsruhe pouk\u00e1zat na nedostatky v zastupov\u00e1n\u00ed jm\u00e9nem org\u00e1n\u016f EU. Ji\u017e ve sv\u00e9m nejzn\u00e1m\u011bj\u0161\u00edm rozhodnut\u00ed o z\u00e1sad\u011b p\u0159ednosti, rozsudku <em>Solange<\/em> z roku 1974, n\u011bme\u010dt\u00ed soudci varovali p\u0159ed t\u00edm, \u017ee org\u00e1ny EU nemaj\u00ed dostate\u010dnou demokratickou \u00farove\u0148, kterou Spolkov\u00e1 republika po\u017eaduje, aby se cel\u00fd obsah Z\u00e1kladn\u00edho z\u00e1kona hypoteticky pod\u0159\u00eddil nadn\u00e1rodn\u00edm ustanoven\u00edm.<\/p>\n<p>T\u00e9m\u011b\u0159 po pades\u00e1ti letech nejvy\u0161\u0161\u00ed pr\u00e1vn\u00ed autorita n\u011bmeck\u00e9ho n\u00e1roda st\u00e1le hodnot\u00ed kvalitu evropsk\u00e9 demokracie jako nedostate\u010dnou. <em>Solangeho<\/em> p\u0159edpoklady a skepse ohledn\u011b prim\u00e1tu se nezm\u011bnily. Z toho lze vyvodit, \u017ee N\u011bmecko, nejbohat\u0161\u00ed st\u00e1t Evropsk\u00e9 unie, vede v n\u00e1rodn\u00edm euroskepticismu p\u0159ed Polskem, Ma\u010farskem, Rumunskem, D\u00e1nskem nebo Nizozemskem, kter\u00e9 toto t\u00e9ma rovn\u011b\u017e zpracovaly.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>8.- P\u0159ednost aplikace neznamen\u00e1 p\u0159ednost platnosti:<\/strong><\/p>\n<p>Dvakr\u00e1t v cel\u00e9m rozsudku zmi\u0148uj\u00ed n\u011bme\u010dt\u00ed soudci pojem<em>&#8222;aplika\u010dn\u00ed p\u0159ednost<\/em>&#8220; (<em>Anwendungsvorrang<\/em>), kter\u00fd je p\u0159izn\u00e1v\u00e1n pr\u00e1vu Evropsk\u00e9 unie.<\/p>\n<p>A\u010dkoli tyto dva odkazy lze kvalifikovat jako <em>obiter dicta<\/em>, \u010dten\u00e1\u0159e bude zaj\u00edmat, co z nich vypl\u00fdv\u00e1: byla \u010di nebyla pr\u00e1vu EU p\u0159izn\u00e1na p\u0159ednost?<\/p>\n<p>I kdyby bylo prvenstv\u00ed EU vymy\u0161leno Soudn\u00edm dvorem Evropsk\u00e9 unie jako neopr\u00e1vn\u011bn\u00fd v\u00fdmysl, do jak\u00e9 m\u00edry ho N\u011bmecko p\u0159ijalo a do jak\u00e9 m\u00edry lze p\u0159edpokl\u00e1dat, \u017ee se ostatn\u00ed n\u00e1rody c\u00edt\u00ed b\u00fdt takov\u00fdm omezen\u00edm vl\u00e1\u010deny, aby p\u0159ijaly rovn\u00e9 podm\u00ednky mezi sedmadvaceti \u010dlensk\u00fdmi st\u00e1ty?<\/p>\n<p>Rozsudek <em>Costa\/ENEL<\/em>, v n\u011bm\u017e Soudn\u00ed dv\u016fr Evropsk\u00e9 unie koncipoval z\u00e1sadu p\u0159ednosti pr\u00e1va EU, obsahoval v ofici\u00e1ln\u00ed n\u011bmeck\u00e9 verzi term\u00edn &#8222;<em>Vorrang<\/em> &#8222;, ve \u0161pan\u011blsk\u00e9m textu &#8222;primac\u00eda&#8220; nebo v angli\u010dtin\u011b &#8222;supremacy&#8220;.<\/p>\n<p> <em>Vorrang<\/em> v\u0161ak nen\u00ed tot\u00e9\u017e co <em>Anwendungsvorrang<\/em>; prvn\u00ed tvo\u0159\u00ed rod a druh\u00fd druh. Germ\u00e1nsk\u00e1 doktr\u00edna toti\u017e rozli\u0161uje dva typy p\u0159ednosti, priority nebo prim\u00e1tu: p\u0159ednost platnosti<em>(Geltungsvorrang)<\/em> a p\u0159ednost aplikace ( <em>Anwendungsvorrang<\/em> uzn\u00e1van\u00fd autory <em>Weissov\u00fdmi<\/em>).<\/p>\n<p>P\u0159ednost platnosti je forma \u0159e\u0161en\u00ed kolize mezi dv\u011bma pr\u00e1vn\u00edmi normami, kdy se jedna z nich ignoruje, proto\u017ee se pou\u017eije pouze ta, kter\u00e1 je pova\u017eov\u00e1na za nad\u0159azenou nebo m\u00e1 p\u0159ednost.<\/p>\n<p>V p\u0159\u00edpad\u011b p\u0159ednosti aplikace se kolizn\u00ed norma (nebo kolizn\u00ed norma, a\u010dkoli se jedn\u00e1 sp\u00ed\u0161e o pravidlo ne\u017e o normu) pou\u017e\u00edv\u00e1 k ur\u010den\u00ed toho, kter\u00fd z obou pr\u00e1vn\u00edch p\u0159\u00edkaz\u016f je t\u0159eba pou\u017e\u00edt a v jak\u00e9m rozsahu.<\/p>\n<p>A pr\u00e1v\u011b to soudci v Karlsruhe ud\u011blali. Kolizn\u00ed normou je samotn\u00fd bonnsk\u00fd z\u00e1kladn\u00ed z\u00e1kon, kter\u00fd ur\u010duje podm\u00ednky, za nich\u017e m\u016f\u017ee vnitrost\u00e1tn\u00ed pr\u00e1vo ustoupit pr\u00e1vu Evropsk\u00e9 unie, jak jsme ji\u017e uk\u00e1zali.<\/p>\n<p>Je t\u0159eba znovu p\u0159ipomenout, \u017ee n\u011bmeck\u00e1 \u00fastava je stanovena jako kolizn\u00ed norma a Spolkov\u00fd \u00fastavn\u00ed soud jako interpreta\u010dn\u00ed a prov\u00e1d\u011bc\u00ed org\u00e1n t\u00e9to normy, tak\u017ee proklamovan\u00e1 aplika\u010dn\u00ed p\u0159ednost (kter\u00e1 nen\u00ed p\u0159ednost\u00ed) je sama o sob\u011b opodstatn\u011bn\u00e1.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>9.- \u0158e\u0161en\u00ed koordinace pop\u00edr\u00e1 p\u0159ednost:<\/strong><\/p>\n<p>Posledn\u00ed \u00favaha vyvrac\u00ed z pr\u00e1vn\u00edho i faktick\u00e9ho hlediska tvrzen\u00ed o p\u0159ednosti pr\u00e1va EU v N\u011bmecku a n\u00e1sledn\u011b v cel\u00e9 Unii.<\/p>\n<p>Pot\u00e9, co \u00fastavn\u00ed soudci zm\u00ednili v\u00fd\u0161e vysv\u011btlenou aplika\u010dn\u00ed p\u0159ednost, hovo\u0159\u00ed o<em>&#8222;koordinaci<\/em>&#8220; mezi vnitrost\u00e1tn\u00ed a evropskou \u00farovn\u00ed. Koordinace v\u0161ak odpov\u00edd\u00e1 podobn\u00fdm pravomocem, proto\u017ee nad\u0159azenost jednoho nad druh\u00fdm by sp\u00ed\u0161e odpov\u00eddala pod\u0159\u00edzenosti, a nikoli koordinaci.<\/p>\n<p>V podobn\u011b sm\u00ed\u0159liv\u00e9m duchu, tedy s pop\u0159en\u00edm evropsk\u00e9 nad\u0159azenosti, \u00dastavn\u00ed soud v Karlsruhe d\u00e1le dod\u00e1v\u00e1, \u017ee nap\u011bt\u00ed vznikaj\u00edc\u00ed mezi vnitrost\u00e1tn\u00edmi a evropsk\u00fdmi org\u00e1ny je t\u0159eba \u0159e\u0161it<em>&#8222;formou spolupr\u00e1ce&#8230; prost\u0159ednictv\u00edm vz\u00e1jemn\u00e9ho respektu a porozum\u011bn\u00ed<\/em>&#8222;.<\/p>\n<p>\u010cten\u00e1\u0159 si m\u016f\u017ee myslet, \u017ee takov\u00e1 terminologie je typick\u00e1 sp\u00ed\u0161e pro politiku ne\u017e pro pr\u00e1vn\u00ed v\u011bdu, proto\u017ee pojmy jako koordinace, spolupr\u00e1ce, respekt nebo porozum\u011bn\u00ed nep\u0159in\u00e1\u0161ej\u00ed p\u0159i \u0159e\u0161en\u00ed dal\u0161\u00edch p\u0159\u00edpad\u016f p\u0159\u00edli\u0161 pr\u00e1vn\u00ed jistoty.<\/p>\n<p>N\u011bme\u010dt\u00ed soudci na\u0161t\u011bst\u00ed dod\u00e1vaj\u00ed relevantn\u00ed vod\u00edtka k pochopen\u00ed a uplat\u0148ov\u00e1n\u00ed t\u00e9to z\u00e1sady koordinace.<\/p>\n<p>Na jedn\u00e9 stran\u011b nesm\u00ed Soudn\u00ed dv\u016fr Evropsk\u00e9 unie uplat\u0148ovat pr\u00e1vo Spole\u010denstv\u00ed bez ohledu na praxi vnitrost\u00e1tn\u00edch soudc\u016f a soud\u016f. Odka\u017eme se zde na p\u0159edchoz\u00ed odd\u00edl a znovu p\u0159ipome\u0148me, \u017ee neexistuje prim\u00e1t platnosti, jakkoli <em>Costa\/ENEL<\/em> p\u0159ed pades\u00e1ti lety za\u010dal sv\u016fj kant prim\u00e1tu<em>(Vorrang<\/em>) v obecn\u00e9 a nejednozna\u010dn\u00e9 podob\u011b, kterou jsme nast\u00ednili.<\/p>\n<p>Na druh\u00e9 stran\u011b m\u00e1 Soudn\u00ed dv\u016fr Evropsk\u00e9 unie pravomoc vykl\u00e1dat a uplat\u0148ovat smlouvy Unie za \u00fa\u010delem zaji\u0161t\u011bn\u00ed jednotnosti a soudr\u017enosti evropsk\u00e9ho pr\u00e1va, a to na z\u00e1klad\u011b mand\u00e1tu ud\u011blen\u00e9ho uveden\u00fdmi smlouvami; tato pravomoc v\u0161ak nen\u00ed v\u00fdlu\u010dn\u00e1, nebo\u0165 &#8222;[s]oudn\u00ed dv\u016fr m\u00e1 pravomoc vykl\u00e1dat a uplat\u0148ovat smlouvy Unie za \u00fa\u010delem zaji\u0161t\u011bn\u00ed jednotnosti a soudr\u017enosti evropsk\u00e9ho pr\u00e1va.&#8220;<em>\u010dlensk\u00e9 st\u00e1ty z\u016fst\u00e1vaj\u00ed p\u00e1ny smluv a Evropsk\u00e1 unie se nevyvinula ve feder\u00e1ln\u00ed st\u00e1t.<\/em>&#8222;.<\/p>\n<p>Tento v\u00fdrok, kter\u00fd, jak je t\u0159eba p\u0159ipomenout, poch\u00e1z\u00ed z N\u011bmecka, ur\u010duje, \u017ee pokud \u010dlensk\u00e9 st\u00e1ty z\u016fst\u00e1vaj\u00ed p\u00e1ny smluv a neexistuje \u017e\u00e1dn\u00fd feder\u00e1ln\u00ed st\u00e1t, kter\u00fd by jim byl nad\u0159azen, zachov\u00e1vaj\u00ed si tak\u00e9 p\u0159\u00edslu\u0161nou pravomoc vykl\u00e1dat tyto smlouvy.<\/p>\n<p>Za norm\u00e1ln\u00edch okolnost\u00ed by m\u011bl vnitrost\u00e1tn\u00ed soudn\u00ed org\u00e1n pova\u017eovat v\u00fdklad pr\u00e1va EU Soudn\u00edm dvorem Unie za z\u00e1vazn\u00fd; pokud je v\u0161ak takov\u00fd v\u00fdklad<em>&#8222;objektivn\u011b sv\u00e9voln\u00fd<\/em>&#8222;, mus\u00ed vnitrost\u00e1tn\u00ed soudy p\u0159ijmout opat\u0159en\u00ed k n\u00e1prav\u011b tohoto excesu.<\/p>\n<p>V tomto p\u0159\u00edpad\u011b se Spolkov\u00fd \u00fastavn\u00ed soud N\u011bmecka domn\u00edv\u00e1, \u017ee tomu tak je, a proto p\u0159istoupil k v\u00fdkladu evropsk\u00e9ho pr\u00e1va, zejm\u00e9na s ohledem na z\u00e1sady p\u0159i\u010ditatelnosti a proporcionality, kter\u00e9 jsou z\u00e1kladn\u00edmi pil\u00ed\u0159i pr\u00e1va EU.<\/p>\n<p>N\u011bmeck\u00fd \u00dastavn\u00ed soud konstatoval, \u017ee z\u00e1sada proporcionality nebyla dodr\u017eena, a zru\u0161il tak p\u0159edchoz\u00ed rozsudek Soudn\u00edho dvora Evropsk\u00e9 unie, kter\u00fd pova\u017eoval za nez\u00e1vazn\u00fd a v N\u011bmecku nepou\u017eiteln\u00fd.<\/p>\n<p>\u010cten\u00e1\u0159 m\u016f\u017ee posoudit, zda ozna\u010den\u00ed v\u00fdkonu rozhodnut\u00ed Evropsk\u00e9ho soudn\u00edho dvora v Lucemburku za sv\u00e9voln\u00fd a nep\u0159im\u011b\u0159en\u00fd je v souladu se spoluprac\u00ed, respektem a porozum\u011bn\u00edm, kter\u00e9 mus\u00ed \u0159\u00eddit<em>&#8222;koordinovan\u00e9&#8220;<\/em> \u0159e\u0161en\u00ed konflikt\u016f na obou \u00farovn\u00edch, n\u00e1rodn\u00ed i unijn\u00ed.<\/p>\n<p>V ka\u017ed\u00e9m p\u0159\u00edpad\u011b lze konstatovat, \u017ee odm\u00edtnut\u00ed n\u00e1roku na pr\u00e1vn\u00ed p\u0159ednost EU, kter\u00e9 p\u0159i\u0161lo z N\u011bmecka prost\u0159ednictv\u00edm <em>Solange<\/em> v roce 1974, nyn\u00ed <em>Weiss<\/em> potvrdil; profesor Bill Davies to mistrn\u011b shrnul p\u0159i anal\u00fdze jurisdik\u010dn\u00ed \u010dinnosti Karlsruhe:<\/p>\n<p>&#8222;<em>Spolkov\u00fd \u00fastavn\u00ed soud, kdy\u017e byl vyzv\u00e1n, aby rozhodl o p\u0159ednosti evropsk\u00e9ho pr\u00e1va, se ocitl v bou\u0159i protich\u016fdn\u00fdch n\u00e1zor\u016f v pov\u00e1le\u010dn\u00e9 Spolkov\u00e9 republice N\u011bmecko.
