d\u011bdictv\u00ed, podle n\u00ed\u017e je pohybliv\u00fd obrazov\u00fd materi\u00e1l ned\u00edlnou sou\u010d\u00e1st\u00ed evropsk\u00e9ho kulturn\u00edho d\u011bdictv\u00ed a m\u011bl by b\u00fdt chr\u00e1n\u011bn pro budoucnost.<br \/>\n\u00damluva popisuje pohybliv\u00fd obraz jako formu um\u011bn\u00ed i jako z\u00e1znam na\u0161\u00ed minulosti, tedy s kulturn\u00edmi, v\u011bdeck\u00fdmi a v\u00fdzkumn\u00fdmi mo\u017enostmi.<br \/>\nPohybliv\u00fd materi\u00e1l zahrnuje jak kinematografick\u00e1 d\u00edla, tak jin\u00e9 z\u00e1znamy na jak\u00e9mkoli m\u00e9diu, jejich\u017e jedinou podm\u00ednkou je zprost\u0159edkov\u00e1n\u00ed dojmu pohybu.<br \/>\nV d\u016fsledku toho zahrnuje televizi, ale nikoli rozhlas.<br \/>\nHlavn\u00edm n\u00e1strojem ochrany je povinnost ratifika\u010dn\u00edch zem\u00ed ulo\u017eit materi\u00e1l pat\u0159\u00edc\u00ed k jejich audiovizu\u00e1ln\u00edmu d\u00edlu, kter\u00fd byl vyroben nebo koprodukov\u00e1n v dan\u00e9 zemi.<br \/>\nZ\u00e1konn\u00e1 \u00faschova zaru\u010duje existenci alespo\u0148 kopie produkce a nav\u00edc obnovu jej\u00edho materi\u00e1lu, aby byl uchr\u00e1n\u011bn p\u0159ed znehodnocen\u00edm.<br \/>\nDepozit dom\u00e1c\u00edch produkc\u00ed n\u00e1le\u017eej\u00edc\u00edch ka\u017ed\u00e9 zemi po vstupu \u00famluvy v platnost je povinn\u00fd.<br \/>\n\u00damluva v\u0161ak podporuje i \/>\nNavzdory povinn\u00e9mu charakteru z\u00e1konn\u00e9ho ulo\u017een\u00ed rozhoduj\u00ed ratifikuj\u00edc\u00ed zem\u011b s kone\u010dnou platnost\u00ed o tom, co je jejich vlastn\u00edm audiovizu\u00e1ln\u00edm d\u011bdictv\u00edm.<br \/>\nTakov\u00e9 rozhodnut\u00ed by nem\u011blo b\u00fdt sv\u00e9voln\u00e9 nebo diskrimina\u010dn\u00ed.<br \/>\nJedn\u00e1 se v\u0161ak o implicitn\u00ed uzn\u00e1n\u00ed toho, \u017ee audiovizu\u00e1ln\u00ed d\u011bdictv\u00ed je nejprve n\u00e1rodn\u00ed a pot\u00e9 evropsk\u00e9, jako kombinace p\u0159\u00edslu\u0161n\u00fdch n\u00e1rodn\u00edch d\u011bdictv\u00ed.<br \/>\nDepozitn\u00ed materi\u00e1l mus\u00ed b\u00fdt p\u016fvodn\u00ed nebo materi\u00e1l, z n\u011bho\u017e lze rekonstruovat p\u016fvodn\u00ed kvalitu.<br \/>\nArchivn\u00ed subjekty mohou b\u00fdt ve\u0159ejn\u00e9 nebo soukrom\u00e9, ale nesm\u00ed je ovl\u00e1dat nikdo, kdo se v medi\u00e1ln\u00edm sektoru zab\u00fdv\u00e1 tvorba nezahrnuje pohybliv\u00fd obrazov\u00fd materi\u00e1l p\u0159en\u00e1\u0161en\u00fd na individu\u00e1ln\u00ed vy\u017e\u00e1d\u00e1n\u00ed a interaktivn\u00ed pohybliv\u00fd obrazov\u00fd materi\u00e1l, to znamen\u00e1, \u017ee protokol se nevztahuje na slu\u017eby videa na vy\u017e\u00e1d\u00e1n\u00ed (VOD) a platformy pro sd\u00edlen\u00ed videa (VSP).<br \/>\nVzhledem k (nap\u0159\u00edklad kinematografick\u00fdch) je toto zohledn\u011bn\u00ed implicitn\u00ed, nikoli v\u0161ak explicitn\u00ed.<br \/>\nLze zde spat\u0159ovat m\u00e9n\u011b vy\u010derp\u00e1vaj\u00edc\u00ed kvalitu z\u00e1konn\u00e9ho depozitu pro televizn\u00ed produkci.<br \/>\nProvozovatel\u00e9 televizn\u00edho vys\u00edl\u00e1n\u00ed mohou vystupovat jako depozit\u00e1\u0159i, pokud je tak zem\u011b ur\u010d\u00ed, a to bu\u010f pro jimi vys\u00edlanou produkci, nebo, pokud s t\u00edm ob\u011b strany souhlas\u00ed, pro produkci jin\u00fdch provozovatel\u016f televizn\u00edho vys\u00edl\u00e1n\u00ed.
