Samotn\u00e9 pr\u00e1vn\u00ed p\u0159edpisy v\u0161ak obsahuj\u00ed ochrann\u00e1 ustanoven\u00ed, kter\u00e1 umo\u017e\u0148uj\u00ed do\u010dasn\u00e9 obnoven\u00ed hrani\u010dn\u00edch kontrol v p\u0159\u00edpad\u011b v\u00e1\u017en\u00e9ho ohro\u017een\u00ed ve\u0159ejn\u00e9ho po\u0159\u00e1dku nebo vnit\u0159n\u00ed bezpe\u010dnosti (\u010dl\u00e1nky 25-30 Schengensk\u00e9ho hrani\u010dn\u00edho kodexu). Rozhodnut\u00ed Polska ze<sup>7.<\/sup> \u010dervence obnovit hrani\u010dn\u00ed kontroly s N\u011bmeckem a Litvou do tohoto pr\u00e1vn\u00edho r\u00e1mce zapad\u00e1. Toto opat\u0159en\u00ed, a\u010dkoli je do\u010dasn\u00e9 a selektivn\u00ed, p\u0159edstavuje akt sebeobrany polsk\u00e9ho st\u00e1tu proti n\u00e1r\u016fstu obchodov\u00e1n\u00ed s lidmi a neleg\u00e1ln\u00edmu vstupu migrant\u016f, co\u017e jsou jevy, kter\u00e9 mohou ohrozit vnit\u0159n\u00ed bezpe\u010dnost i soci\u00e1ln\u00ed soudr\u017enost.   <\/p>\n<p>NELEG\u00c1LN\u00cd P\u0158IST\u011aHOVALECTV\u00cd: ROSTOUC\u00cd HROZBA<\/p>\n<p>Neleg\u00e1ln\u00ed p\u0159ist\u011bhovalectv\u00ed nelze pova\u017eovat pouze za administrativn\u00ed z\u00e1le\u017eitost; jedn\u00e1 se o slo\u017eit\u00fd, mnohorozm\u011brn\u00fd a neust\u00e1le se vyv\u00edjej\u00edc\u00ed jev, kter\u00fd m\u00e1 hlubok\u00e9 hospod\u00e1\u0159sk\u00e9, soci\u00e1ln\u00ed a zdravotn\u00ed d\u016fsledky, p\u0159edev\u0161\u00edm z hlediska n\u00e1rodn\u00ed bezpe\u010dnosti. Neopr\u00e1vn\u011bn\u00fd vstup ciz\u00edch st\u00e1tn\u00edch p\u0159\u00edslu\u0161n\u00edk\u016f ohro\u017euje schopnost \u00fa\u010dinn\u011b a racion\u00e1ln\u011b \u0159\u00eddit leg\u00e1ln\u00ed migra\u010dn\u00ed toky a m\u011bn\u00ed rovnov\u00e1hu, kterou st\u00e1ty zavedly sv\u00fdmi syst\u00e9my pl\u00e1nov\u00e1n\u00ed a p\u0159ij\u00edm\u00e1n\u00ed. Tato dynamika ve skute\u010dnosti p\u0159et\u011b\u017euje vnitrost\u00e1tn\u00ed mechanismy mezin\u00e1rodn\u00ed ochrany a humanit\u00e1rn\u00ed pomoci, zt\u011b\u017euje identifikaci skute\u010dn\u00fdch situac\u00ed zranitelnosti a podporuje vylou\u010den\u00ed a marginalizaci. Neleg\u00e1ln\u00ed p\u0159ist\u011bhovalectv\u00ed je nav\u00edc \u010dasto \u00fazce propojeno s nadn\u00e1rodn\u00edmi zlo\u010dineck\u00fdmi s\u00edt\u011bmi, zejm\u00e9na t\u011bmi, kter\u00e9 se pod\u00edlej\u00ed na obchodov\u00e1n\u00ed s lidmi, p\u0159evad\u011b\u010dstv\u00ed a pracovn\u00edm vyko\u0159is\u0165ov\u00e1n\u00ed a kter\u00e9 prosperuj\u00ed d\u00edky slab\u00e9 kontrole a nerovn\u00fdm p\u0159edpis\u016fm v evropsk\u00fdch zem\u00edch. Tento jev m\u00e1 dopad i na leg\u00e1ln\u00ed ekonomiku, nebo\u0165 podporuje nehl\u00e1\u0161enou pr\u00e1ci a v n\u011bkter\u00fdch p\u0159\u00edpadech i zneu\u017e\u00edv\u00e1n\u00ed syst\u00e9m\u016f soci\u00e1ln\u00edho zabezpe\u010den\u00ed, \u010d\u00edm\u017e podkop\u00e1v\u00e1 udr\u017eitelnost ve\u0159ejn\u00fdch slu\u017eeb a vyvol\u00e1v\u00e1 odpor mezi m\u00edstn\u00edm obyvatelstvem. Tato nespokojenost se m\u016f\u017ee prom\u00edtnout do soci\u00e1ln\u00edho nap\u011bt\u00ed a p\u0159isp\u011bt k politick\u00e9 nestabilit\u011b a rozt\u0159\u00ed\u0161t\u011bn\u00ed demokratick\u00e9ho konsensu. Ned\u00e1vn\u00e1 opat\u0159en\u00ed p\u0159ijat\u00e1 Polskem, jako je znovuzaveden\u00ed hrani\u010dn\u00edch kontrol, byla zd\u016fvod\u0148ov\u00e1na n\u00e1r\u016fstem p\u0159evad\u011b\u010dsk\u00fdch aktivit migrant\u016f, k nim\u017e \u00fadajn\u011b \u010d\u00e1ste\u010dn\u011b p\u0159isp\u011blo m\u00e9n\u011b d\u016fsledn\u00e9 \u0159\u00edzen\u00ed tok\u016f ze strany n\u011bmeck\u00fdch a litevsk\u00fdch org\u00e1n\u016f. Z tohoto pohledu se neleg\u00e1ln\u00ed p\u0159ist\u011bhovalectv\u00ed jev\u00ed nejen jako v\u00fdzva pro n\u00e1rodn\u00ed spr\u00e1vu, ale tak\u00e9 jako zkou\u0161ka soudr\u017enosti a solidarity mezi \u010dlensk\u00fdmi st\u00e1ty Evropsk\u00e9 unie.       <\/p>\n<p>P\u0158IM\u011a\u0158ENOST A SELEKTIVITA OPAT\u0158EN\u00cd<\/p>\n<p>Jedn\u00edm z hlavn\u00edch pozitivn\u00edch prvk\u016f polsk\u00e9ho opat\u0159en\u00ed je jeho proporcionalita. Kontroly byly aktivov\u00e1ny na po\u010d\u00e1te\u010dn\u00ed obdob\u00ed 30 dn\u016f s mo\u017enost\u00ed prodlou\u017een\u00ed pouze v p\u0159\u00edpad\u011b p\u0159etrv\u00e1vaj\u00edc\u00edch probl\u00e9m\u016f. Selektivita kontrol (zam\u011b\u0159en\u00fdch na podez\u0159el\u00e1 vozidla, jako jsou autobusy, dod\u00e1vky s tmav\u00fdmi skly a automobily s velk\u00fdm po\u010dtem cestuj\u00edc\u00edch) nav\u00edc minimalizuje dopad na b\u011b\u017en\u00e9 cestuj\u00edc\u00ed a p\u0159eshrani\u010dn\u00ed obchod. Ministr vnitra Tomasz Siemoniak prohl\u00e1sil, \u017ee c\u00edlem nen\u00ed br\u00e1nit mobilit\u011b, ale sp\u00ed\u0161e p\u0159edch\u00e1zet neleg\u00e1ln\u00ed \u010dinnosti a bojovat proti n\u00ed. V tomto smyslu je opat\u0159en\u00ed zcela v souladu se z\u00e1sadami nezbytnosti a p\u0159im\u011b\u0159enosti zakotven\u00fdmi v pr\u00e1vu EU.    <\/p>\n<p>POS\u00cdLEN\u00cd BEZPE\u010cNOSTI A D\u016eV\u011aRY VE\u0158EJNOSTI<\/p>\n<p>Viditeln\u00e1 p\u0159\u00edtomnost org\u00e1n\u016f \u010dinn\u00fdch v trestn\u00edm \u0159\u00edzen\u00ed na hranic\u00edch m\u00e1 tak\u00e9 pozitivn\u00ed psychologick\u00fd \u00fa\u010dinek na obyvatelstvo. V dob\u011b rostouc\u00edho vn\u00edm\u00e1n\u00ed nejistoty m\u016f\u017ee pos\u00edlen\u00ed hrani\u010dn\u00edch kontrol zv\u00fd\u0161it pocit ochrany a d\u016fv\u011bry ve st\u00e1tn\u00ed instituce. Nasazen\u00ed 1 800 policist\u016f je jasn\u00fdm sign\u00e1lem odhodl\u00e1n\u00ed vl\u00e1dy br\u00e1nit \u00fazemn\u00ed celistvost a ve\u0159ejn\u00fd po\u0159\u00e1dek. Tato opat\u0159en\u00ed p\u0159isp\u00edvaj\u00ed k prevenci p\u0159eshrani\u010dn\u00ed trestn\u00e9 \u010dinnosti, v\u010detn\u011b obchodov\u00e1n\u00ed s drogami, zbran\u011bmi, prostituce a pa\u0161ov\u00e1n\u00ed. Jin\u00fdmi slovy, kontrola vn\u011bj\u0161\u00edch a vnit\u0159n\u00edch hranic Evropsk\u00e9 unie je nejen z\u00e1konnou povinnost\u00ed, ale i nezbytnou sou\u010d\u00e1st\u00ed ka\u017ed\u00e9 modern\u00ed bezpe\u010dnostn\u00ed politiky.    <\/p>\n<p>ODPOV\u011aDNOST A MEZIN\u00c1RODN\u00cd SPOLUPR\u00c1CE<\/p>\n<p>Obnoven\u00ed hrani\u010dn\u00edch kontrol je rovn\u011b\u017e sou\u010d\u00e1st\u00ed \u0161ir\u0161\u00edho kontextu vz\u00e1jemn\u00e9 odpov\u011bdnosti mezi \u010dlensk\u00fdmi st\u00e1ty, zejm\u00e9na vzhledem k nedostate\u010dn\u00e9 koordinaci mezi n\u011bkter\u00fdmi sousedn\u00edmi zem\u011bmi. Aby schengensk\u00fd syst\u00e9m \u0159\u00e1dn\u011b fungoval, vy\u017eaduje, aby ka\u017ed\u00fd st\u00e1t \u00fa\u010dinn\u011b kontroloval sv\u00e9 hranice a spolupracoval se sv\u00fdmi sousedy. Bez t\u00e9to z\u00e1sady reciprocity hroz\u00ed, \u017ee se evropsk\u00e1 solidarita zm\u011bn\u00ed v asymetrii a nerovnov\u00e1hu. Gesto Polska proto nelze vykl\u00e1dat jako jednostrann\u00e9 uzav\u0159en\u00ed, ale jako v\u00fdzvu k dialogu a dodr\u017eov\u00e1n\u00ed spole\u010dn\u00fdch pravidel.   <\/p>\n<p>OCHRANA HRANIC JAKO P\u0158EDPOKLAD INTEGRACE.<\/p>\n<p>Evropsk\u00e1 integrace je zalo\u017eena na ur\u010dit\u00fdch z\u00e1kladn\u00edch pil\u00ed\u0159\u00edch: jednotn\u00fd trh, voln\u00fd pohyb, solidarita a bezpe\u010dnost. Z\u00e1kladem, na n\u011bm\u017e lze tyto hodnoty konkr\u00e9tn\u011b realizovat, je v\u0161ak ochrana vnit\u0159n\u00edho po\u0159\u00e1dku a kontrola hranic. Bez \u00fa\u010dinn\u00fdch kontrol se svoboda pohybu m\u016f\u017ee st\u00e1t zranitelnou; bez p\u0159\u00edsn\u00fdch krit\u00e9ri\u00ed pro vstup je obt\u00ed\u017en\u011bj\u0161\u00ed \u0159\u00eddit soci\u00e1ln\u00ed za\u010dlen\u011bn\u00ed. Z tohoto pohledu by politiky boje proti neleg\u00e1ln\u00edmu p\u0159ist\u011bhovalectv\u00ed nem\u011bly b\u00fdt vn\u00edm\u00e1ny jako konflikt s lidsk\u00fdmi pr\u00e1vy, ale sp\u00ed\u0161e jako n\u00e1stroj pro vyv\u00e1\u017een\u00ed p\u0159ijatelnosti a z\u00e1konnosti.   <\/p>\n<p>EKONOMICK\u00c9 D\u016eSLEDKY<\/p>\n<p>Protesty n\u011bkter\u00fdch podnikatelsk\u00fdch sdru\u017een\u00ed, kter\u00e1 se ob\u00e1vaj\u00ed zpo\u017ed\u011bn\u00ed na hranic\u00edch, je t\u0159eba posuzovat tak\u00e9 s ohledem na dlouhodob\u00e9 p\u0159\u00ednosy. Do\u010dasn\u00e9 hrani\u010dn\u00ed kontroly sice mohou zp\u016fsobit drobn\u00e1 zpo\u017ed\u011bn\u00ed v doprav\u011b nebo nep\u0159\u00edjemnosti pro doj\u00ed\u017ed\u011bj\u00edc\u00ed, pos\u00edlen\u00ed z\u00e1konnosti v\u0161ak p\u0159edstavuje investici do stability a p\u0159edv\u00eddatelnosti. Leg\u00e1ln\u00ed ekonomika toti\u017e vzkv\u00e9t\u00e1 pouze v prost\u0159ed\u00ed, kde jsou pravidla jasn\u00e1, hranice bezpe\u010dn\u00e9 a podniky mohou fungovat bez obav z nekal\u00e9 konkurence ze strany neleg\u00e1ln\u00edch subjekt\u016f. Svoboda pohybu nem\u016f\u017ee existovat bez d\u016fsledn\u00e9ho vym\u00e1h\u00e1n\u00ed pr\u00e1va.   <\/p>\n<p>DO\u010cASN\u00c9 KONTROLY JAKO N\u00c1STROJ INSTITUCION\u00c1LN\u00cd ODOLNOSTI.<\/p>\n<p>Polsk\u00e9 znovuzaveden\u00ed hrani\u010dn\u00edch kontrol, a\u010dkoli ho n\u011bkte\u0159\u00ed mezin\u00e1rodn\u00ed pozorovatel\u00e9 a z\u00fa\u010dastn\u011bn\u00e9 strany kritizuj\u00ed, p\u0159edstavuje jasn\u00fd p\u0159\u00edklad institucion\u00e1ln\u00ed odolnosti tv\u00e1\u0159\u00ed v tv\u00e1\u0159 \u010detn\u00fdm kriz\u00edm. Ve st\u00e1le nestabiln\u011bj\u0161\u00edm geopolitick\u00e9m kontextu, kdy Evropsk\u00e1 unie \u010del\u00ed komplexn\u00edm a vz\u00e1jemn\u011b propojen\u00fdm hrozb\u00e1m (jako je mezin\u00e1rodn\u00ed terorismus, hybridn\u00ed v\u00e1lka, tlak neregulovan\u00fdch migra\u010dn\u00edch tok\u016f a rostouc\u00ed nap\u011bt\u00ed na jej\u00edch v\u00fdchodn\u00edch hranic\u00edch), se pos\u00edlen\u00ed suver\u00e9nn\u00edch kontroln\u00edch kapacit jev\u00ed nejen jako ospravedlniteln\u00e9 z hlediska demokratick\u00e9 legitimity, ale tak\u00e9 jako nezbytn\u00e9 pro efektivitu a ochranu kolektivn\u00ed bezpe\u010dnosti. Opat\u0159en\u00ed p\u0159ijat\u00e9 Var\u0161avou lze interpretovat jako pragmatickou a v\u00edce\u00farov\u0148ovou reakci, jej\u00edm\u017e c\u00edlem je br\u00e1nit \u00fazemn\u00ed celistvost zem\u011b, \u00fa\u010dinn\u011b bojovat proti organizovan\u00e9mu zlo\u010dinu a s\u00edt\u00edm p\u0159eshrani\u010dn\u00edho obchodov\u00e1n\u00ed s lidmi a zachovat ve\u0159ejn\u00fd po\u0159\u00e1dek a pr\u00e1vn\u00ed st\u00e1t v dob\u011b zranitelnosti. Krom\u011b toho p\u0159isp\u00edv\u00e1 k pos\u00edlen\u00ed d\u016fv\u011bry ob\u010dan\u016f ve st\u00e1tn\u00ed instituce a prokazuje konkr\u00e9tn\u00ed schopnost reagovat na potenci\u00e1ln\u011b destabilizuj\u00edc\u00ed situace. Polsk\u00e9 rozhodnut\u00ed rovn\u011b\u017e zd\u016fraz\u0148uje pot\u0159ebu prosazovat symetri\u010dt\u011bj\u0161\u00ed a odpov\u011bdn\u011bj\u0161\u00ed p\u0159\u00edstup \u010dlensk\u00fdch st\u00e1t\u016f, v n\u011bm\u017e je b\u0159emeno bezpe\u010dnosti rozd\u011bleno spravedliv\u00fdm a koordinovan\u00fdm zp\u016fsobem. Z ekonomick\u00e9ho hlediska m\u016f\u017ee p\u0159ijet\u00ed do\u010dasn\u00fdch kontrol pomoci zajistit transparentn\u011bj\u0161\u00ed a konkurenceschopn\u011bj\u0161\u00ed podm\u00ednky pro leg\u00e1ln\u00ed hospod\u00e1\u0159skou \u010dinnost a zabr\u00e1nit tomu, aby naru\u0161en\u00ed p\u0159eshrani\u010dn\u00edch tok\u016f podporovalo nez\u00e1konn\u00e9 nebo naru\u0161uj\u00edc\u00ed praktiky.
