Dicen que Trump deber\u00eda haber pedido el consentimiento del Congreso para declarar la guerra a Venezuela y que infringi\u00f3 el derecho internacional al enviar una fuerza militar a Caracas para detener a Nicol\u00e1s Maduro y a su esposa, ambos con \u00f3rdenes de detenci\u00f3n en su contra en Estados Unidos. Sus cr\u00edticas me llevaron a reflexionar sobre el caso.  <\/p>\n<h3 style=\"font-weight: 400;\">El secreto, clave del \u00e9xito<\/h3>\n<p style=\"font-weight: 400;\">En primer lugar, Trump no estaba librando una guerra contra Venezuela. Por lo tanto, no necesitaba el consentimiento del Congreso. Su equipo estaba deteniendo a dos delincuentes y llev\u00e1ndolos ante la justicia. Aunque la pareja no ha sido condenada en un tribunal estadounidense, las pruebas contra ellos son abrumadoras. La clave del \u00e9xito de esta operaci\u00f3n fue su estricto secreto. No s\u00f3lo hab\u00eda dejado su cargo convirti\u00e9ndose en un tirano -como habr\u00edan dicho los fil\u00f3sofos medievales-, sino que tambi\u00e9n hab\u00eda perdido las elecciones presidenciales de 2024. Estaba claro para todos los observadores imparciales que Mar\u00eda Corina Machado (a quien no se le permiti\u00f3 presentarse) contaba con el apoyo de la mayor\u00eda de los votantes. As\u00ed pues, Maduro no s\u00f3lo era un usurpador, sino tambi\u00e9n un defraudador electoral, aunque \u00e9sta no fue la raz\u00f3n por la que fue detenido.   <\/p>\n<h3 style=\"font-weight: 400;\">El secuestro de Eichmann<\/h3>\n<p style=\"font-weight: 400;\">La segunda objeci\u00f3n, que Trump infringi\u00f3 el derecho internacional, no puede eliminarse tan f\u00e1cilmente. Cuando una fuerza militar del pa\u00eds A entra en el pa\u00eds B sin el consentimiento de las autoridades competentes y detiene a alguien, sea o no un delincuente conocido, se viola la soberan\u00eda del pa\u00eds B. El respeto de la soberan\u00eda nacional parece ser parte integrante del derecho internacional.  <\/p>\n<p style=\"font-weight: 400;\">A este respecto, algunos precedentes pueden ser \u00fatiles. En 1960, el Estado de Israel envi\u00f3 un equipo especial a Argentina. Secuestraron al nazi alem\u00e1n Adolf Eichmann, que viv\u00eda all\u00ed con un nombre falso, y lo llevaron a Israel. Argentina protest\u00f3 contra esta violaci\u00f3n de su soberan\u00eda, y el Consejo de Seguridad de la ONU consider\u00f3 que tal violaci\u00f3n de la soberan\u00eda podr\u00eda, si se repet\u00eda, amenazar la paz. Israel y Argentina resolvieron el caso mediante una declaraci\u00f3n conjunta en la que ambos estados consideraban el caso cerrado. Argentina reconoci\u00f3 t\u00e1citamente el derecho de Israel a juzgar a Eichmann. Los tribunales israel\u00edes decidieron que la forma posiblemente ilegal en que fue detenido Eichmann no era importante para el caso contra \u00e9l, que se basaba en su participaci\u00f3n en el asesinato de millones de jud\u00edos durante la Segunda Guerra Mundial.      <\/p>\n<h3 style=\"font-weight: 400;\">Uganda y Panam\u00e1<\/h3>\n<p style=\"font-weight: 400;\">Cabe recordar otros dos casos. En 1976, terroristas \u00e1rabes secuestraron un avi\u00f3n que se dirig\u00eda a Israel y lo dirigieron al aeropuerto de Entebbe, en Uganda. En una audaz operaci\u00f3n, un equipo israel\u00ed irrumpi\u00f3 en el aeropuerto y rescat\u00f3 a los rehenes. Murieron todos los terroristas y algunos soldados ugandeses que les ayudaban, pero s\u00f3lo un miembro del equipo israel\u00ed. Aunque el secretario general de la ONU, Kurt Waldheim, acus\u00f3 a Israel de haber violado la soberan\u00eda de Uganda, la operaci\u00f3n fue ampliamente aclamada. En 1989, fuerzas militares estadounidenses invadieron Panam\u00e1 y detuvieron al dictador Manuel Noriega, que previamente hab\u00eda anulado unas elecciones presidenciales y acosado a ciudadanos estadounidenses.     <\/p>\n<h3 style=\"font-weight: 400;\">La aceptaci\u00f3n es crucial<\/h3>\n<p style=\"font-weight: 400;\">La incursi\u00f3n de Entebbe y la invasi\u00f3n de Panam\u00e1 se diferencian de los otros dos casos en que, posiblemente, se llevaron a cabo en defensa propia. Esto no era obviamente cierto en el caso de Maduro, y mucho menos en el de Eichmann. Sin embargo, la diferencia entre Eichmann y Maduro fue que Eichmann fue juzgado y condenado con arreglo a la legislaci\u00f3n internacional y no a la israel\u00ed, mientras que Maduro fue detenido y acusado por infringir la legislaci\u00f3n estadounidense. Es ciertamente problem\u00e1tico que Estados Unidos pueda aplicar a su antojo sus leyes a ciudadanos de otros Estados bajo otras jurisdicciones. Pero lo crucial en ambos casos es que los representantes leg\u00edtimos de los dos pa\u00edses cuya soberan\u00eda hab\u00eda sido vulnerada, Argentina y Venezuela, aceptaron la necesidad de llevar a los dos criminales ante la justicia.
