Europska komisija izdala je <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=CELEX:52024DC0261\">izvje\u0161\u0107e<\/a> i radni dokument osoblja o provedbi Direktive 2010\/13\/EU, poznate i kao Direktiva o audiovizualnim medijskim uslugama (AMSD). Konkretno, izvje\u0161\u0107e analizira u kojoj se mjeri europska djela promi\u010du putem audiovizualnih medijskih usluga. Izvje\u0161\u0107e ne pokriva samo situaciju u dvadeset i sedam dr\u017eava \u010dlanica, ve\u0107 i na Islandu, Lihten\u0161tajnu i Norve\u0161koj, zemljama koje pripadaju Europskom udru\u017eenju slobodne trgovine (EFTA) i Europskom gospodarskom prostoru (EEA). Izvje\u0161\u0107e koristi podatke koje je omogu\u0107io Europski audiovizualni opservatorij pri Vije\u0107u Europe. AMSD je izmijenjen Direktivom (EU) 2018\/1808, koja poja\u010dava pravila o promicanju europskih djela audiovizualnim medijskim uslugama. Takva se pravila mogu podijeliti u dvije kategorije: obveze kvota i isticanja, s jedne strane, i obveze financijskih ulaganja, s druge strane. \u010clanak 13. izmijenjenog AMSD-a obvezuje dr\u017eave \u010dlanice da osiguraju da pru\u017eatelji medijskih usluga audiovizualnih medijskih usluga na zahtjev &#8211; pru\u017eatelji video-na-zahtjev (VOD) &#8211; pod svojom jurisdikcijom osiguraju najmanje 30% udjela europskih djela u svojim katalozima i osigurati istaknutost tih djela. S druge strane, od dr\u017eava \u010dlanica EU-a o\u010dekuje se da nametnu financijske doprinose pru\u017eateljima VOD-a kako bi promicale proizvodnju europskih djela, uklju\u010duju\u0107i putem izravnih ulaganja u sadr\u017eaj i\/ili doprinosa nacionalnim fondovima. Tradicionalni pru\u017eatelji usluga linearnog (emitiranja) tako\u0111er imaju svoje obveze promicanja europskog rada prema \u010dlancima 16. i 17. AMSD-a. Radio-televizijske ku\u0107e moraju rezervirati za europska djela ve\u0107inu svog vremena emitiranja, isklju\u010duju\u0107i vrijeme dodijeljeno vijestima, sportskim doga\u0111ajima, igrama, ogla\u0161avanju, uslugama teleteksta i teletrgovini. Tako\u0111er trebaju rezervirati najmanje 10% svog vremena prijenosa ili svog programskog bud\u017eeta za nezavisna europska djela. Obvezni pru\u017eatelji usluga ne moraju biti samo oni s poslovnim nastanom pod jurisdikcijom dr\u017eave \u010dlanice, ve\u0107 to tako\u0111er mo\u017ee nametnuti obveze pru\u017eateljima koji ciljaju publiku na njihovom teritoriju, \u010dak i ako imaju poslovni nastan u drugoj dr\u017eavi \u010dlanici. \u0160to se ti\u010de SVOD usluga, izvje\u0161\u0107e je pokazalo da su njihovi prihodi koji dolaze iz EU-a porasli sa 6,7 \u200b\u200bmilijardi eura u 2019. na 11,7 milijardi u 2021. (porast od 43%). Ukupni broj VOD usluga koje su operativne u jurisdikcijama zemalja EU-a i EGP-a, EFTA-e tako\u0111er je porastao s 1030 u 2019. na 1984 u 2021. (pove\u0107anje od 93%). Dr\u017eave \u010dlanice izvijestile su da je prosje\u010dni udio europskih radova na VOD uslugama varirao izme\u0111u 63-64% u razdoblju 2020.-2021.; to je znatno vi\u0161e od njihovog prosjeka od 42-63% koji odgovara razdoblju 2015.-2019. Me\u0111utim, Europska komisija iznosi manje optimisti\u010dne podatke, naime prosje\u010dan udio europskih radova na VOD uslugama od 36% za 2021. i 35% za 2023. \u0160to se ti\u010de linearnih usluga, ukupni broj TV kanala blago je smanjen s 4657 u 2019. EU &#8211; uklju\u010duju\u0107i u to vrijeme UK &#8211; na 4483 u 2021. (smanjenje od 4%). Sve dr\u017eave \u010dlanice zapravo zahtijevaju od nakladnika da rezerviraju ve\u0107inu svog vremena emitiranja za europska djela, a neke dr\u017eave \u010dlanice zahtijevaju ve\u0107i udio ili za javne nakladnike ili za sve nakladnike. <\/p>\n<p>  Zapravo, prosje\u010dni udio europskih radova na linearnim uslugama \u2013 68 % 2020. i 69 % 2021. \u2013 bio je daleko iznad obveznog ve\u0107inskog udjela, prema izvje\u0161\u0107ima dr\u017eava \u010dlanica. To ukazuje na pad u odnosu na 2019. (72,6%). \u0160tovi\u0161e, analiza u studiji sugerira da je udio europskih djela (38%) znatno ispod udjela europskih djela koje u prosjeku prijavljuju dr\u017eave \u010dlanice. Sedam dr\u017eava \u010dlanica nametnulo je obveze financijskog doprinosa za prekograni\u010dne pru\u017eatelje VOD usluga i dvije za prekograni\u010dne pru\u017eatelje linearnih usluga. Naposljetku, \u0161to se ti\u010de djela neovisnih producenata, prosjek je bio 40,6% u 2020. i 41,4% u 2021., prema podacima koje su dostavile dr\u017eave \u010dlanice. Me\u0111utim, prema Europskoj komisiji, bio je manji od 3%, \u0161to je dramati\u010dna razlika izme\u0111u nacionalnih podataka i izvje\u0161\u0107a Bruxellesa. Kao zaklju\u010dak, mogli bismo tvrditi da bi europska djela trebala biti u mogu\u0107nosti posti\u0107i uspjeh temeljen na kvaliteti, a ne na subvencijama.
