Rezult\u0103 c\u0103 o astfel de lege nu are niciun fel de \u00eent\u00e2ietate fa\u021b\u0103 de o identitate constitu\u021bional\u0103 na\u021bional\u0103, care, prin urmare, func\u021bioneaz\u0103 \u00een primul r\u00e2nd sau cu \u00eent\u00e2ietate.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"3\">\n<li><u>  Primatul dreptului german, a\u0219a cum a fost stabilit la nivel na\u021bional:<\/u><\/li>\n<\/ol>\n<p>Intr\u00e2nd acum \u00een ra\u021bionamentul juridic pe fond, Curtea Constitu\u021bional\u0103 Federal\u0103 dezvolt\u0103 o prim\u0103 analiz\u0103 a ceea ce implic\u0103 dreptul de vot conferit germanilor la alegerea membrilor lor reprezentativi \u00een <em>Bundestag<\/em>, camera inferioar\u0103 a Republicii, \u00eenfiin\u021bat\u0103 \u00een 1949.<\/p>\n<p>Judec\u0103torii de la Karlsruhe afirm\u0103 c\u0103 acest drept &#8222;<strong>nu se limiteaz\u0103 la o legitimare formal\u0103 a puterii \u00een favoarea statului (federal). Dreptul cet\u0103\u021benilor la autodeterminare democratic\u0103 se aplic\u0103, de asemenea, \u00een contextul integr\u0103rii europene. \u00cen cadrul domeniului de aplicare a articolului 23 alineatul (1) din Constitu\u021bie, acesta protejeaz\u0103 \u00eempotriva unui abuz manifest \u0219i semnificativ din punct de vedere structural al competen\u021belor sale de c\u0103tre institu\u021biile, organele, oficiile \u0219i agen\u021biile Uniunii Europene. De asemenea, confer\u0103 protec\u021bie atunci c\u00e2nd actele institu\u021biilor, organelor, oficiilor \u0219i agen\u021biilor Uniunii Europene dep\u0103\u0219esc limitele cuprinse \u00een principiile proclamate la articolele 1 \u0219i 20 din Legea fundamental\u0103, pe care articolul 79 alineatul (3) din Legea fundamental\u0103 le declar\u0103 inviolabile.<\/strong>&#8221;<\/p>\n<p>Ne intereseaz\u0103 \u00een special aceast\u0103 ultim\u0103 fraz\u0103, \u00een leg\u0103tur\u0103 cu \u00eenceputul argument\u0103rii. Dreptul de vot al germanilor la alegerea principalilor lor deputa\u021bi na\u021bionali \u00eei protejeaz\u0103 \u00eempotriva actelor entit\u0103\u021bilor Uniunii care ar putea contraveni dispozi\u021biilor a dou\u0103 articole din Constitu\u021bia lor, chiar dac\u0103 aceste acte ar putea fi valabile \u00een temeiul dreptului Uniunii Europene.<\/p>\n<p>\u00centr-adev\u0103r, prin cea de-a doua tez\u0103 a paragrafului, Curtea Constitu\u021bional\u0103 german\u0103 neag\u0103 faptul c\u0103 integrarea european\u0103 a Germaniei implic\u0103 faptul c\u0103 dreptul Uniunii ar trebui s\u0103 prevaleze asupra<strong>&#8222;autodetermin\u0103rii democratice<\/strong>&#8221; a cet\u0103\u021benilor germani, manifestat\u0103 \u00een primul r\u00e2nd prin dreptul lor de a alege membrii <em>Bundestagului<\/em>, dar care nu se limiteaz\u0103 \u00een mod formal la aceasta.<\/p>\n<p>Acesta este un st\u00e2lp al hot\u0103r\u00e2rii. Chiar \u0219i dup\u0103 integrarea Germaniei \u00een Uniunea European\u0103, corpul principal al puterii legislative reprezint\u0103 &#8222;autodeterminarea democratic\u0103&#8221; din partea cet\u0103\u021benilor s\u0103i; \u0219i nu \u00een mod pur formal, ci \u0219i desf\u0103\u0219urarea material\u0103 a competen\u021belor sale, \u00een esen\u021b\u0103 dreptul na\u021bional, se bucur\u0103 de o preeminen\u021b\u0103 semnificativ\u0103 fa\u021b\u0103 de produsul institu\u021biilor, organismelor, oficiilor \u0219i agen\u021biilor Uniunii Europene.<\/p>\n<p>Prin urmare, dreptul na\u021bional manifestat ca lege care rezult\u0103 din ac\u021biunea <em>Bundestagului<\/em> nu cedeaz\u0103 neap\u0103rat \u00een fa\u021ba celei care provine de la entit\u0103\u021bile europene. Astfel, con\u021binutul pretinsului primat al dreptului european \u00een temeiul <em>Costa\/ENEL<\/em> este distrus, precum \u0219i toate consecin\u021bele jurispruden\u021biale \u0219i doctrinare ale acestuia la nivelul UE.<\/p>\n<p>Chiar dac\u0103 entit\u0103\u021bile europene nu ar abuza de atribu\u021biile lor, a\u0219a cum afirm\u0103 \u00een mod explicit magistra\u021bii germani, exist\u0103 domenii ale dreptului na\u021bional care au \u00eent\u00e2ietate, a\u0219a cum a stabilit constitu\u021bia na\u021bional\u0103.<\/p>\n<p>Vom analiza, desigur, cele dou\u0103 precepte constitu\u021bionale care creeaz\u0103 o astfel de preponderen\u021b\u0103 na\u021bional\u0103 asupra sferei UE. Dar, mai presus de toate, cititorul trebuie s\u0103 observe c\u0103 acest primat al dreptului na\u021bional este declarat de dou\u0103 instan\u021be na\u021bionale, \u0219i anume puterea constituant\u0103 german\u0103 a Republicii Federale exprimat\u0103 \u00een Legea fundamental\u0103 \u0219i jurispruden\u021ba constitu\u021bional\u0103 declarat\u0103 la Karlsruhe.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"4\">\n<li><u>  Primatul \u00een favoarea unei p\u0103r\u021bi semnificative a legisla\u021biei na\u021bionale:<\/u><\/li>\n<\/ol>\n<p>Atunci c\u00e2nd Curtea Constitu\u021bional\u0103 Federal\u0103 German\u0103 define\u0219te domeniile \u00een care, chiar \u0219i \u00een lipsa unui abuz din partea entit\u0103\u021bilor UE, dreptul german se bucur\u0103 de un statut de \u00eent\u00e2ietate fa\u021b\u0103 de dreptul european, aceasta se refer\u0103 la dou\u0103 precepte din <em>Grundgesetz<\/em> Bonn, \u0219i anume articolele 1 \u0219i 20.<\/p>\n<p>Articolul 1 proclam\u0103 pe scurt respectul \u0219i protec\u021bia demnit\u0103\u021bii umane \u0219i recunoa\u0219terea drepturilor omului care decurg din aceasta.<\/p>\n<p>Implica\u021biile unei astfel de proclama\u021bii sunt, desigur, foarte relevante, de\u0219i nu pot fi dezvoltate mai departe aici. Cu toate acestea, este \u00eentr-adev\u0103r important de subliniat c\u0103, datorit\u0103 celui de-al treilea paragraf al aceluia\u0219i articol, constituantul republican extinde la articolele 2-19 obliga\u021bia de conduit\u0103 \u00een numele celor trei ramuri ale guvernului &#8211; legislativ\u0103, executiv\u0103 \u0219i judiciar\u0103 -, ceea ce implic\u0103, de fapt, \u00eent\u00e2ietatea unei p\u0103r\u021bi foarte importante a constitu\u021biei germane asupra dreptului european.<\/p>\n<p>Adic\u0103, cu privire la toate chestiunile care se refer\u0103 la protec\u021bia sau dezvoltarea drepturilor fundamentale prev\u0103zute \u00een Legea fundamental\u0103 german\u0103. Cititorul va \u00een\u021belege ce presupune acest lucru din punct de vedere obiectiv (ne vom referi mai jos \u0219i la implica\u021biile sale subiective).<\/p>\n<p>At\u00e2ta timp c\u00e2t este vorba despre una dintre cele optsprezece dispozi\u021bii privind drepturile fundamentale enumerate \u00een aceast\u0103 prim\u0103 sec\u021biune a Legii fundamentale de la Bonn, na\u021biunea german\u0103 poate invoca \u00eent\u00e2ietatea dispozi\u021biilor sale fa\u021b\u0103 de cele care provin de la institu\u021biile Uniunii Europene care se ocup\u0103 de acelea\u0219i subiecte.<\/p>\n<p>Dezvoltarea liber\u0103 a personalit\u0103\u021bii, a vie\u021bii \u0219i a integrit\u0103\u021bii fizice; egalitatea; libertatea de credin\u021b\u0103, de con\u0219tiin\u021b\u0103, libertatea religioas\u0103 \u0219i ideologic\u0103, libertatea de cult \u0219i de participare la armat\u0103; libertatea de exprimare \u0219i libertatea presei, dreptul la onoare, libertatea educa\u021biei; protec\u021bia c\u0103s\u0103toriei \u0219i a familiei, dreptul \u0219i obliga\u021bia de \u00eengrijire \u0219i educa\u021bie a copiilor; dreptul la \u00eentruniri pa\u0219nice; dreptul de asociere; secretul comunica\u021biilor; libertatea de circula\u021bie \u0219i de \u0219edere; dreptul de a-\u0219i alege liber profesia; inviolabilitatea domiciliului; dreptul la proprietate \u0219i la mo\u0219tenire; cet\u0103\u021benia \u0219i interzicerea extr\u0103d\u0103rii; dreptul de azil; dreptul de peti\u021bionare; precum \u0219i toate chestiunile legate de reglementarea restric\u021biilor asupra acestor drepturi fundamentale &#8211; pentru fiecare dintre aceste aspecte, dreptul german are prioritate fa\u021b\u0103 de dreptul Uniunii Europene.<\/p>\n<p>\u00cen ceea ce prive\u0219te articolul 20, acesta descrie pe scurt fundamentele Republicii Federale Germania \u0219i dreptul la rezisten\u021b\u0103, care, prin urmare, prevaleaz\u0103, de asemenea, asupra oric\u0103ror instrumente juridice care provin de la Uniunea suprana\u021bional\u0103.<\/p>\n<p>Acest lucru \u00eenseamn\u0103, \u00een primul r\u00e2nd, c\u0103 caracterul federal, democratic \u0219i social al Republicii \u00eenfiin\u021bate \u00een 1949 nu poate fi afectat de niciun instrument juridic al UE.
