Tranzi\u021bia c\u0103tre un punct de referin\u021b\u0103 al politicilor migratorii europene merit\u0103 o analiz\u0103 aprofundat\u0103, \u00een special \u00een lumina pre\u0219edin\u021biei semestriale daneze a Consiliului UE. Pozi\u021bia istoric\u0103 \u0219i politic\u0103 a Danemarcei privind imigra\u021bia poate fi, de fapt, avantajoas\u0103 din punct de vedere strategic pentru promovarea \u0219i punerea \u00een aplicare a unor politici comune de combatere a imigra\u021biei ilegale, de asemenea \u00een direc\u021bia a ceea ce guvernul italian \u00eencearc\u0103 s\u0103 pun\u0103 \u00een aplicare prin acordurile cu Albania. Aceast\u0103 transformare trebuie citit\u0103 \u00een contextul mai larg al dinamicii interne a UE, \u00een care politicile migratorii sunt tot mai mult influen\u021bate de considerente de securitate, control demografic \u0219i gestionarea opiniei publice. Spre deosebire de multe state membre, Danemarca face uz de o clauz\u0103 care \u00eei permite s\u0103 nu adere pe deplin la sistemul european comun de azil (SECA). Aceast\u0103 autonomie a facilitat adoptarea de politici deosebit de restrictive \u00eencep\u00e2nd cu criza migratorie din 2015-2016. La numai dou\u0103 zile dup\u0103 adoptarea pactului, guvernul danez a publicat o scrisoare comun\u0103 semnat\u0103 de 15 \u021b\u0103ri, inclusiv de actori-cheie precum Italia, Grecia \u0219i \u021a\u0103rile de Jos, \u00een care externalizarea procedurilor de azil era propus\u0103 ca o solu\u021bie eficient\u0103 \u0219i durabil\u0103. Nu numai pentru agenda migra\u021biei, ci \u0219i pentru posibilitatea de a influen\u021ba direct mecanismele decizionale europene. Guvernul danez \u00ee\u0219i propune s\u0103 ajung\u0103 la un acord p\u00e2n\u0103 la sf\u00e2r\u0219itul anului, nu numai cu privire la externalizarea procedurilor, ci \u0219i cu privire la redefinirea conceptului de &#8222;\u021bar\u0103 ter\u021b\u0103 sigur\u0103&#8221; &#8211; un nod juridic central care condi\u021bioneaz\u0103 posibilitatea transferului migran\u021bilor \u00een afara teritoriului UE. Din punct de vedere institu\u021bional, pre\u0219edin\u021bia ofer\u0103 instrumente semnificative pentru a pilota agenda politic\u0103.   <\/p>\n<p>EXCEP\u021aIA SOCIAL-DEMOCRAT\u0102: PARADOXUL ST\u00c2NGII RESTRICTIVE<\/p>\n<p>Un element distinctiv al cazului danez este reprezentat de identitatea politic\u0103 a guvernului s\u0103u. Spre deosebire de ceea ce se \u00eent\u00e2mpl\u0103 \u00een alte contexte europene, \u00een Danemarca aceast\u0103 limitare a migra\u021biei este promovat\u0103 de un executiv social-democrat. O strategie care a dat rezultate: Danemarca este una dintre pu\u021binele \u021b\u0103ri \u00een care un guvern socialist a reu\u0219it s\u0103 men\u021bin\u0103 o baz\u0103 electoral\u0103 solid\u0103 \u00eentr-un context european \u00een general nefavorabil st\u00e2ngii tradi\u021bionale.    <\/p>\n<p>PERSPECTIVE DE VIITOR: SPRE O NOU\u0102 ARHITECTUR\u0102 EUROPEAN\u0102?<\/p>\n<p>Pre\u0219edin\u021bia danez\u0103 ar putea marca un punct de cotitur\u0103 \u00een modul \u00een care Europa abordeaz\u0103 problema migra\u021biei. Dac\u0103 Copenhaga ar reu\u0219i s\u0103 ghideze cu succes aprobarea unui cadru juridic pentru externalizarea procedurilor de azil, s-ar crea un precedent cu implica\u021bii durabile. Modelul acordurilor bilaterale cu \u021b\u0103ri ter\u021be pentru hub-urile din afara UE difer\u0103 semnificativ de logica care, p\u00e2n\u0103 \u00een prezent, a informat abordarea european\u0103 a migra\u021biei, centrat\u0103 pe redistribuirea intern\u0103 a solicitan\u021bilor de azil, cooperarea interstatal\u0103 \u0219i respectarea conven\u021biilor interna\u021bionale privind refugia\u021bii. Externalizarea &#8211; dac\u0103 ar fi institu\u021bionalizat\u0103 &#8211; ar reprezenta o schimbare de paradigm\u0103, \u00een care controlul frontierelor nu ar mai fi o prerogativ\u0103 geografic\u0103, ci una politic\u0103 \u0219i contractual\u0103. Experien\u021ba Danemarcei, ancorat\u0103 \u00eentr-o structur\u0103 de reglementare autonom\u0103 \u00een ceea ce prive\u0219te SECA, ofer\u0103 \u021b\u0103rii flexibilitatea necesar\u0103 pentru a propune solu\u021bii pe care alte state membre au \u00eenceput abia recent s\u0103 le ia \u00een considerare. Cu toate acestea, succesul acestui proiect va depinde de capacitatea de a reconcilia nevoile de control \u0219i drepturile fundamentale, o provocare juridic\u0103 \u0219i moral\u0103 considerabil\u0103. Riscul este de a inaugura o paradigm\u0103 care, de\u0219i satisface opiniile publice na\u021bionale, compromite principiile fondatoare ale Uniunii. De fapt, politicile de descurajare &#8211; dac\u0103 nu sunt \u00eenso\u021bite de mecanisme de garan\u021bie juridic\u0103, transparen\u021b\u0103 administrativ\u0103 \u0219i monitorizare independent\u0103 &#8211; pot degenera \u00een practici discriminatorii sau arbitrare, \u00een contradic\u021bie cu Carta drepturilor fundamentale a UE. Curtea de Justi\u021bie a Uniunii \u0219i Curtea European\u0103 a Drepturilor Omului ar putea juca un rol crucial \u00een stabilirea limitelor legitime ale externaliz\u0103rii, \u00een special \u00een ceea ce prive\u0219te principiul nereturn\u0103rii \u0219i dreptul la un recurs efectiv. Pozi\u021bia istoric\u0103 a Danemarcei privind imigra\u021bia, c\u00e2ndva marginal\u0103 \u0219i criticat\u0103, s-a transformat \u00eentr-o resurs\u0103 strategic\u0103 \u00een noul context european. Consolidat\u0103 de o experien\u021b\u0103 \u00eendelungat\u0103 \u00een domeniul politicilor restrictive \u0219i de o capacitate de conducere institu\u021bional\u0103 garantat\u0103 de pre\u0219edin\u021bia Consiliului UE, Copenhaga este acum \u00een m\u0103sur\u0103 s\u0103 influen\u021beze \u00een mod decisiv viitoarele politici europene privind migra\u021bia. Dar aceast\u0103 influen\u021b\u0103 este \u00eenso\u021bit\u0103 de necesitatea de a ob\u021bine consim\u021b\u0103m\u00e2ntul nu numai \u00eentre statele membre, ci \u0219i \u00een cadrul societ\u0103\u021bii civile \u0219i al institu\u021biilor europene. \u00cen absen\u021ba unui sprijin politic \u0219i de reglementare larg, punerea \u00een aplicare a mecanismelor externalizate risc\u0103 s\u0103 fragmenteze \u0219i mai mult echilibrul deja fragil al politicilor migratorii comune. Totu\u0219i, aceast\u0103 influen\u021b\u0103 implic\u0103 o responsabilitate remarcabil\u0103. Modelul danez nu poate fi exportat f\u0103r\u0103 o reflec\u021bie critic\u0103 asupra limitelor sale, at\u00e2t \u00een ceea ce prive\u0219te sustenabilitatea economic\u0103, c\u00e2t \u0219i compatibilitatea juridic\u0103. Numai o abordare care integreaz\u0103 eficien\u021ba administrativ\u0103, protec\u021bia drepturilor omului \u0219i legitimitatea politic\u0103 va fi cu adev\u0103rat capabil\u0103 s\u0103 ofere o solu\u021bie comun\u0103 \u0219i durabil\u0103 la fenomenul migra\u021biei ilegale. \u00cen aceast\u0103 perspectiv\u0103, ac\u021biunea danez\u0103 va trebui s\u0103 se m\u0103soare nu numai \u00een func\u021bie de capacitatea de a ob\u021bine rezultate imediate, ci \u0219i \u00een func\u021bie de impactul pe termen lung al reformelor propuse. \u00cen acest sens, pre\u0219edin\u021bia danez\u0103 reprezint\u0103 nu numai o oportunitate politic\u0103, ci \u0219i un test pentru \u00eentreaga Uniune European\u0103: succesul sau e\u0219ecul ini\u021biativelor propuse va marca profund viitorul politicilor europene \u00een domeniul migra\u021biei pentru anii urm\u0103tori.
