Cu votul favorabil al Adun\u0103rii, statele membre dob\u00e2ndesc capacitatea de a declara inadmisibile cererile de azil depuse \u00een Uniune \u0219i de a transfera solicitan\u021bii \u00een state cu care nu au leg\u0103turi personale anterioare, cu condi\u021bia \u00eendeplinirii anumitor condi\u021bii \u0219i a respect\u0103rii unor garan\u021bii juridice specifice. Aceast\u0103 interven\u021bie legislativ\u0103 face parte dintr-o strategie european\u0103 mai ampl\u0103 care vizeaz\u0103 externalizarea unei p\u0103r\u021bi din gestionarea cererilor de protec\u021bie interna\u021bional\u0103 prin intermediul cooper\u0103rii structurate cu \u021b\u0103ri ter\u021be. Anterior, posibilitatea de a transfera un solicitant de azil c\u0103tre o \u021bar\u0103 din afara UE presupunea existen\u021ba unei leg\u0103turi semnificative \u00eentre solicitant \u0219i \u021bara de destina\u021bie. Odat\u0103 cu modificarea aprobat\u0103, o astfel de leg\u0103tur\u0103 nu mai este o condi\u021bie necesar\u0103. Statele membre vor putea aplica conceptul de \u021bar\u0103 ter\u021b\u0103 sigur\u0103 chiar \u0219i persoanelor care nu sunt cet\u0103\u021beni ai \u021b\u0103rii respective \u0219i care nu au locuit niciodat\u0103 \u00een \u021bara respectiv\u0103. \u00cen consecin\u021b\u0103, o cerere de protec\u021bie interna\u021bional\u0103 depus\u0103 la nivelul UE poate fi declarat\u0103 inadmisibil\u0103 dac\u0103 solicitantul este direc\u021bionat c\u0103tre o \u021bar\u0103 ter\u021b\u0103 considerat\u0103 sigur\u0103 \u00een conformitate cu criteriile stabilite de legisla\u021bia european\u0103. Cu toate acestea, noul regulament impune \u00eendeplinirea a cel pu\u021bin uneia dintre cele trei condi\u021bii alternative: prima se refer\u0103 la existen\u021ba unei leg\u0103turi \u00eentre solicitant \u0219i \u021bara ter\u021b\u0103, cum ar fi prezen\u021ba membrilor familiei, o re\u0219edin\u021b\u0103 anterioar\u0103 sau leg\u0103turi lingvistice \u0219i culturale; a doua se refer\u0103 la tranzitul solicitantului printr-un stat \u00een care acesta ar fi putut solicita protec\u021bie efectiv\u0103 \u00eenainte de a ajunge \u00een Uniune; a treia, mai inovatoare, implic\u0103 existen\u021ba unui acord sau a unei \u00een\u021belegeri, \u00eencheiate bilateral, multilateral sau direct de Uniunea European\u0103, pentru admiterea solicitan\u021bilor de azil, cu excep\u021bia minorilor ne\u00eenso\u021bi\u021bi.     <\/p>\n<p>GARAN\u021aII JURIDICE \u0218I OBLIGA\u021aII ALE \u021a\u0102RILOR TER\u021aE<\/p>\n<p>Pentru ca transferurile s\u0103 fie conforme cu dreptul european \u0219i interna\u021bional, acordurile cu \u021b\u0103rile ter\u021be trebuie s\u0103 con\u021bin\u0103 o clauz\u0103 obligatorie care s\u0103 impun\u0103 \u021b\u0103rii de destina\u021bie s\u0103 examineze pe fond orice cerere de protec\u021bie efectiv\u0103 depus\u0103 de persoanele transferate. Cu alte cuvinte, \u021bara ter\u021b\u0103 trebuie s\u0103 garanteze un sistem de azil func\u021bional care respect\u0103 standardele interna\u021bionale. Regulamentul stabile\u0219te c\u0103 transferurile pot avea loc numai c\u0103tre state considerate &#8222;sigure&#8221;, adic\u0103 \u021b\u0103ri care garanteaz\u0103 protec\u021bie \u00eempotriva persecu\u021biilor \u0219i v\u0103t\u0103m\u0103rilor grave, respectarea principiului nereturn\u0103rii \u0219i posibilitatea de a ob\u021bine protec\u021bie \u00een temeiul Conven\u021biei de la Geneva privind refugia\u021bii. Drepturile de \u0219edere \u0219i alte prerogative, cum ar fi accesul la educa\u021bie \u0219i la locuri de munc\u0103, trebuie, de asemenea, s\u0103 fie garantate. O excep\u021bie semnificativ\u0103 se refer\u0103 la minorii ne\u00eenso\u021bi\u021bi, ale c\u0103ror cereri de azil vor continua s\u0103 fie evaluate de \u021b\u0103rile europene sau de statele cu care au o leg\u0103tur\u0103 sau prin care au tranzitat. Aceast\u0103 dispozi\u021bie r\u0103spunde necesit\u0103\u021bii de a consolida protec\u021bia unui grup deosebit de vulnerabil.     <\/p>\n<p>PRIMA LIST\u0102 EUROPEAN\u0102 DE &#8222;\u021a\u0102RI DE ORIGINE SIGURE&#8221;<\/p>\n<p>\u00cen paralel cu reforma conceptului de \u021b\u0103ri ter\u021be sigure, Parlamentul European a aprobat prima list\u0103 comun\u0103 a Uniunii de &#8222;\u021b\u0103ri de origine sigure&#8221;. Aceast\u0103 list\u0103 include Bangladesh, Columbia, Egipt, India, Kosovo, Maroc \u0219i Tunisia, precum \u0219i toate \u021b\u0103rile candidate la aderarea la Uniunea European\u0103, cu excep\u021bia Ucrainei. Conceptul de \u021bar\u0103 de origine sigur\u0103, distinct de cel de \u021bar\u0103 ter\u021b\u0103 sigur\u0103, urm\u0103re\u0219te s\u0103 accelereze procesarea cererilor de azil depuse de cet\u0103\u021benii statelor considerate \u00een general ca respect\u00e2nd drepturile fundamentale. \u00cen aceste cazuri, procedurile vor fi tratate cu celeritate, p\u0103str\u00e2ndu-se \u00een acela\u0219i timp dreptul solicitantului de a demonstra existen\u021ba unui risc individual.   <\/p>\n<p>DEZBATEREA PARLAMENTAR\u0102 \u0218I DIVIZIUNEA POLITIC\u0102<\/p>\n<p>Amendamentul legislativ a fost aprobat cu 396 de voturi pentru, 226 \u00eempotriv\u0103 \u0219i 30 de ab\u021bineri. Rezultatul a fost posibil datorit\u0103 alian\u021bei dintre Partidul Popular European, Conservatorii \u0219i Reformi\u0219tii Europeni, Patrio\u021bii pentru Europa \u0219i grupul Europa Na\u021biunilor Suverane. \u00cen schimb, grupurile Sociali\u0219tilor \u0219i Democra\u021bilor \u0219i Renew Europe au votat cov\u00e2r\u0219itor \u00eempotriv\u0103, cu toate c\u0103 au existat unele dezert\u0103ri. Votul a eviden\u021biat o fractur\u0103 \u00een alian\u021ba parlamentar\u0103 care sprijin\u0103 Comisia condus\u0103 de Ursula von der Leyen, o dinamic\u0103 care a ap\u0103rut deja \u00een alte dosare privind migra\u021bia \u00een timpul sesiunii legislative. Unii deputa\u021bi de st\u00e2nga \u0219i liberali au prezentat o pozi\u021bie minoritar\u0103, calific\u00e2nd noul concept de \u021bar\u0103 ter\u021b\u0103 sigur\u0103 ca fiind deosebit de problematic \u0219i exprim\u00e2ndu-\u0219i \u00eengrijorarea cu privire la riscul de exploatare de c\u0103tre \u021b\u0103rile ter\u021be.    <\/p>\n<p>ROLUL ITALIEI \u0218I PRECEDENTUL HUB-URILOR DIN ALBANIA<\/p>\n<p>Reforma deschide calea pentru acorduri \u00eentre statele membre ale UE \u0219i guvernele \u021b\u0103rilor ter\u021be care doresc s\u0103 accepte solicitan\u021bi de azil din Europa, inclusiv \u00een schimbul unei compensa\u021bii financiare. Acest model aminte\u0219te de experien\u021ba guvernului anterior al Regatului Unit, care semnase un acord cu Rwanda pentru transferul migran\u021bilor ilegali. Acest proiect a fost ulterior blocat de Curtea Suprem\u0103 britanic\u0103 \u0219i abandonat de actualul guvern. \u00cen cadrul dezbaterii europene privind externalizarea procedurilor de azil, Italia a adoptat o pozi\u021bie de pionierat \u00een ultimii ani, promov\u00e2nd crearea de centre pentru procesarea cererilor de protec\u021bie interna\u021bional\u0103 \u00een Albania. Aceste ini\u021biative, \u00eent\u00e2mpinate ini\u021bial cu scepticism \u0219i uneori cu critici deschise \u00een Europa, se bazau pe ideea de a consolida cooperarea cu \u021b\u0103rile ter\u021be pentru a reduce presiunea asupra sistemelor na\u021bionale de primire. Perspectiva italian\u0103, orientat\u0103 spre gestionarea extern\u0103 \u0219i comun\u0103 a fluxurilor de migra\u021bie, a fost mult timp considerat\u0103 marginal\u0103 \u00een contextul UE. Cu toate acestea, evolu\u021bia reglement\u0103rilor, culmin\u00e2nd cu recenta modificare a Regulamentului privind procedura de azil, eviden\u021biaz\u0103 o convergen\u021b\u0103 progresiv\u0103 c\u0103tre solu\u021bii care promoveaz\u0103 acorduri structurate cu \u021b\u0103rile ter\u021be, cu condi\u021bia ca acestea s\u0103 fie \u00eenso\u021bite de garan\u021bii juridice adecvate. \u00cen acest sens, experien\u021ba centrelor din Albania poate fi privit\u0103 ca un precedent politic care a contribuit la orientarea dezbaterii europene c\u0103tre modele mai eficiente de cooperare extern\u0103. Decizia UE de a formaliza, printr-un cadru de reglementare comun, posibilitatea de a transfera solicitan\u021bii de azil \u00een \u021b\u0103ri cu care nu au nicio leg\u0103tur\u0103 personal\u0103 reprezint\u0103 un pas care, \u00een ciuda diferen\u021belor opera\u021bionale, se \u00eenscrie \u00een aceea\u0219i logic\u0103 a gestion\u0103rii partajate \u0219i descentralizate a cererilor de protec\u021bie.        <\/p>\n<p>\u00ceNTRE EFICIEN\u021a\u0102 \u0218I PROTEC\u021aIA DREPTURILOR<\/p>\n<p>Reforma aprobat\u0103 de Parlamentul European reprezint\u0103 un punct de cotitur\u0103 semnificativ \u00een dreptul de azil, extinz\u00e2nd instrumentele de care dispun statele membre pentru a gestiona cererile de protec\u021bie interna\u021bional\u0103. Eliminarea cerin\u021bei leg\u0103turilor personale cu \u021bara ter\u021b\u0103 l\u0103rge\u0219te sfera de manevr\u0103 a autorit\u0103\u021bilor na\u021bionale \u0219i consolideaz\u0103 dimensiunea extern\u0103 a politicii europene \u00een domeniul migra\u021biei. \u00cen acela\u0219i timp, criticile formulate \u00een Parlament eviden\u021biaz\u0103 provoc\u0103rile pe care aceast\u0103 abordare le ridic\u0103 \u00een ceea ce prive\u0219te protec\u021bia drepturilor fundamentale \u0219i eficacitatea garan\u021biilor procedurale. Echilibrul \u00eentre controlul fluxurilor, cooperarea interna\u021bional\u0103 \u0219i protec\u021bia persoanelor vulnerabile r\u0103m\u00e2ne problema central\u0103 a unei politici care continu\u0103 s\u0103 provoace diviziuni profunde. \u00cen acest context, rolul Italiei \u00een promovarea solu\u021biilor inovatoare de cooperare cu \u021b\u0103rile ter\u021be pare s\u0103 fac\u0103 parte dintr-o traiectorie mai larg\u0103, \u00een care Uniunea European\u0103 pare orientat\u0103 c\u0103tre integrarea permanent\u0103 a instrumentelor de externalizare \u00een arhitectura sa de reglementare.
