{"id":31801,"date":"2024-08-10T10:06:50","date_gmt":"2024-08-10T10:06:50","guid":{"rendered":"https:\/\/www.theconservative.online\/finns-det-en-konstitutionell-struktur-for-eu"},"modified":"2024-08-10T10:06:50","modified_gmt":"2024-08-10T10:06:50","slug":"finns-det-en-konstitutionell-struktur-for-eu","status":"publish","type":"post","link":"https:\/\/www.theconservative.online\/sv\/finns-det-en-konstitutionell-struktur-for-eu","title":{"rendered":"Finns det en konstitutionell struktur f\u00f6r EU?"},"content":{"rendered":"<p>De flesta moderna liberala demokratier har tre grenar: den lagstiftande, den verkst\u00e4llande och den d\u00f6mande makten, vilket \u00e4r en kopia av USA:s konstitution fr\u00e5n 1787.<br \/>\nEuropeiska unionen \u00e4r inte en federation, men i j\u00e4mf\u00f6relse med den tredelade strukturen omfattar de nuvarande f\u00f6rdragen (eller EU:s prim\u00e4rr\u00e4tt) sju institutioner: Europaparlamentet, Europeiska r\u00e5det, r\u00e5det, Europeiska kommissionen (eller helt enkelt kommissionen), Europeiska unionens domstol, Europeiska centralbanken och revisionsr\u00e4tten.<br \/>\nOm det vore f\u00f6r ordningens skull i artikel 13 i EU-f\u00f6rdraget skulle man kunna anta att Europeiska r\u00e5det \u00e4r n\u00e4st viktigast av de sju.<br \/>\n\u00c5 andra sidan bidrar likheten mellan dess namn och r\u00e5dets namn till en viss f\u00f6rvirring bland allm\u00e4nheten.<br \/>\nEuropaparlamentet har nyligen publicerat en <a href=\"https:\/\/www.europarl.europa.eu\/thinktank\/en\/document\/IPOL_STU(2024)760125\">studie<\/a> om Europeiska r\u00e5dets roll i EU:s institutionella struktur, f\u00f6r att klarg\u00f6ra nuvarande och kanske \u00e4ven framtida f\u00f6rh\u00e5llanden.<br \/>\nStudien, som har till syfte att analysera Europeiska r\u00e5dets befogenheter, har titeln &#8221;Europeiska r\u00e5dets roll i EU:s konstitutionella struktur&#8221;.<br \/>\nMen finns det n\u00e5got som heter konstitutionell struktur i EU, n\u00e4r EU:s utkast till konstitution uttryckligen f\u00f6rkastades i folkomr\u00f6stningar i Frankrike och Nederl\u00e4nderna och d\u00e4rf\u00f6r inte godk\u00e4ndes?<br \/>\nEnligt EU:s prim\u00e4rr\u00e4tt fastst\u00e4ller Europeiska r\u00e5det de allm\u00e4nna politiska prioriteringarna, inklusive den gemensamma utrikes- och s\u00e4kerhetspolitiken och andra omr\u00e5den av unionens yttre \u00e5tg\u00e4rder.<br \/>\nDet l\u00f6ser ocks\u00e5 d\u00f6dl\u00e4gen inom politikomr\u00e5den, t.ex. enligt artiklarna 82 och 83 i f\u00f6rdraget om Europeiska unionens funktionss\u00e4tt, n\u00e4r en medlemsstat anser att ett utkast till direktiv skulle p\u00e5verka grundl\u00e4ggande aspekter av dess straffr\u00e4ttsliga system.<br \/>\nDen fastst\u00e4ller ocks\u00e5 om en medlemsstat har brutit mot EU:s v\u00e4rden (artikel 7 i f\u00f6rdraget om Europeiska unionen).<br \/>\nSom en tredje typ av befogenheter f\u00e5r Europeiska r\u00e5det ingripa n\u00e4r det g\u00e4ller \u00e4ndringar av f\u00f6rdragen, i enlighet med artikel 48 i f\u00f6rdraget om Europeiska unionen.<br \/>\nI denna best\u00e4mmelse n\u00e4mns dock inte begreppet &#8221;konstitutionell \u00e4ndring&#8221;, utan endast f\u00f6rdrags\u00e4ndring.<br \/>\nVid ett senare tillf\u00e4lle erk\u00e4nner studien att Europeiska r\u00e5det i praktiken ger de andra institutionerna riktlinjer om EU:s institutionella ramverk, men inte om ett f\u00f6rmodat &#8221;konstitutionellt ramverk&#8221; som de sj\u00e4lvutn\u00e4mnda federalisterna s\u00e5 g\u00e4rna vill ha.<br \/>\nI studien kallas Brexitprocessen f\u00f6r en &#8221;konstitutionell fr\u00e5ga&#8221;, men \u00e5terigen, om vi l\u00e4ser artikel 50 i f\u00f6rdraget om Europeiska unionen ser vi att termen &#8221;konstitution&#8221; inte n\u00e4mns \u00f6verhuvudtaget, utan att det helt enkelt \u00e4r ett s\u00e4tt f\u00f6r en medlemsstat att uttr\u00e4da ur unionen genom ett bilateralt avtal, fr\u00e5n grunden.<br \/>\nFinanspakten tas sedan upp som ett exempel p\u00e5 ytterligare en konstitutionell fr\u00e5ga d\u00e4r Europeiska r\u00e5det hittills skulle ha gett instruktioner till andra institutioner.<br \/>\nMen om ett s\u00e5dant avtal, f\u00f6rdraget om stabilitet, samordning och styrning inom Ekonomiska och monet\u00e4ra unionen av den 2 mars 2012, skulle ha konstitutionell status, skulle det inneb\u00e4ra att EU:s f\u00f6rmodade konstitution skulle vara <em>mycket<\/em> \u00f6ppen och inte bara omfatta de tre f\u00f6rdrag som erk\u00e4nns som prim\u00e4rr\u00e4tt, utan \u00e4ven detta fj\u00e4rde f\u00f6rdrag och kanske \u00e4ven andra.<br \/>\nVad skulle det vara f\u00f6r mening med en konstitution som de konstituerande medlemsstaterna inte ens vet exakt vad den \u00e4r?
