L\u00e5t oss p\u00e5minna om att naturr\u00e4tten enligt Thomas av Aquino \u00e4r den f\u00f6rnuftiga varelsens deltagande i den eviga lagen, genom vilken Gud planerar och leder alla sina varelser till att utvecklas mot sin egen full\u00e4ndning.<\/p>\n<p>V\u00e5r f\u00f6rfattare likst\u00e4ller konservativa med traditionalister i ett visst samh\u00e4lle: De konservativa \u00e4r b\u00e4rare av f\u00e4dernas principer, och man kan r\u00e4kna med att de inte kommer att mots\u00e4tta sig f\u00f6r\u00e4ndring i sig, utan f\u00f6r\u00e4ndring i en riktning som strider mot eller \u00e4r f\u00f6rbjuden av f\u00e4dernas principer.<\/p>\n<p>Enligt Dr. Kendall kan d\u00e4rf\u00f6r en traditionalist eller konservativ verkligen f\u00f6r\u00e4ndra eller \u00e4ndra principerna, \u00e4ven om detta m\u00e5ste g\u00f6ras. (i) genom allm\u00e4nt samtycke, (ii) i strikt \u00f6verensst\u00e4mmelse med de f\u00f6rfaranden som fastst\u00e4llts av de ursprungliga grundarna, och (iii) i en riktning som inte strider mot eller f\u00f6rbjuds av dessa ursprungliga principer.<\/p>\n<p>Detta tredje element \u00e4r mycket viktigt, eftersom traditionen, s\u00e5som den omfamnas av konservativa som professor Kendall, i slut\u00e4ndan kr\u00e4ver mer \u00e4n bara f\u00f6rfarandem\u00e4ssiga villkor f\u00f6r f\u00f6r\u00e4ndring eller utveckling; det finns ocks\u00e5 ett materiellt krav som kr\u00e4ver en anpassning av resultatet av f\u00f6r\u00e4ndringen till sakernas tillst\u00e5nd f\u00f6re en s\u00e5dan f\u00f6r\u00e4ndring eller \u00e4ndring. Vi skulle kunna till\u00e4gga att detta \u00e4r en mots\u00e4ttning mellan tradition och revolution, mellan organisk utveckling och laboratorieexperiment, mellan l\u00e5ngsam utveckling och social ingenj\u00f6rskonst.<\/p>\n<p>Dr Kendall accepterar konstitutionellt samf\u00f6rst\u00e5nd, genom vilket folket uttrycker sin identitet och sin k\u00e4nsla av syfte i historien. Men \u00e4nnu en g\u00e5ng r\u00e4cker inte detta f\u00f6r en konservativ man, utan han kr\u00e4ver ocks\u00e5 att det inneh\u00e5ll som man enats om genom ett s\u00e5dant konstitutionellt samf\u00f6rst\u00e5nd i grunden motsvarar samma folks arv eller intellektuella arv.<\/p>\n<p>Ett s\u00e5dant intellektuellt arv inneb\u00e4r f\u00f6rst och fr\u00e4mst att man erk\u00e4nner att Gud \u00e4r suver\u00e4n \u00f6ver b\u00e5de nationer och individer som tillh\u00f6r dessa nationer. Denna f\u00f6rsta egenskap st\u00e5r i strid med den jacobinism som inf\u00f6rdes 1789 och dess arvtagare, laicismen, som vi k\u00e4nner den idag.<\/p>\n<p>Professor Kendall till\u00e4gger att det konstitutionella samf\u00f6rst\u00e5ndet inte bara m\u00e5ste erk\u00e4nna Gud, m\u00e4nniskor och nationer, utan ocks\u00e5 mellanliggande gemenskaper som familjer eller f\u00f6reningar, som staten inte kan undg\u00e5 att erk\u00e4nna. Dessutom \u00e4r demokrati inte ett m\u00e5l i sig sj\u00e4lvt, utan har ett v\u00e4rde som ett medel f\u00f6r att uppn\u00e5 r\u00e4ttvisa.<\/p>\n<p>Majoritetsregeln skapar stabilitet, men det finns ocks\u00e5 ett behov av etisk respekt. Det r\u00e4cker inte med en enkel majoritet. Dr Kendall inst\u00e4mmer i Anatole Frances citat: &#8221;En dumhet som upprepas av trettiosex miljoner munnar \u00e4r inte mindre dumhet&#8221;. Majoriteter kan inte mots\u00e4tta sig verkligheten; professor Kendall anv\u00e4nder tv\u00e5 exempel f\u00f6r att st\u00e4lla sig p\u00e5 Anatole Frances sida p\u00e5 denna punkt: en majoritet kommer aldrig att upph\u00e4va gravitationslagen eller minska \u03c0 fr\u00e5n 3,14.<\/p>\n<p>Han forts\u00e4tter med att kritisera John Locke f\u00f6r att han har samma princip om att en individ har en skyldighet att underkasta sig majoritetens beslut och att l\u00e5ta den besluta.
